Dilemma.. need some suggestions

I recently purchased an item from an international seller paying for it with my paypal account via credit card.

The transaction took place in the early part of December & I just received the item last Saturday.

I contacted the seller immediately to advise her that the item is not
in the condition that is reflected in her pictures. There are several
nicks in the bracelet & there is no signature either.

I have sent her 3 e-mails regarding this & she has not responded.
I understand there is a time difference between the two of us & the
holidays are over, so there should be no dealy in why she hasn't responded.
There is also no language barrier.. she understands & communicates
in English very well.

I have purchased other items from her in the past & there has never been
an issue.

I can dispute the charge with my credit card or I can file with Paypal.

I just want to give her the opportunity to respond but so far no answer
before I either file a SNAD or dispute the charge..

Any suggestions or thoughts??

Just file a dispute with Paypal. Paypal will send the seller an email and she gets around 2 weeks or so to reply before Paypal decides if they should refund you. That will be ample time! If you keep waiting and she chooses to ignore you, you probably won't ever get a refund until end of February.
 
You've got 45 days to open a dispute. Since you've dealt with this seller before and they've been good, I'd wait a little bit longer, just be careful to not wait too long.


I just don't want to lose that window of opportunity for filing..

I do want to give her the opportunity to respond but I have
sent emails on Jan 5, 7, & 9th..

If she would acknowledge them in some manner we can resolve
this amicably.

I will give her another few days...

OP, you don't say whether this was an ebay purchase, but if it was, the dispute is better filed with ebay. If an off-ebay purchase such as private sale or Bonz, then file with PP.

Although you don't give exact dates, it sounds as though it's been over 30 days since purchase and in the last week that you've sent 3 messages. I'd give her until the end of today to respond and if there's no contact, perhaps an email notifying her of a dispute will light a fire under her.

In the meantime, prepare your case with clear pictures showing the problems.

BB, it was not an ebay purchase... It was with a private seller
who I have buying from for several years & we do our transactions
via PP....

The purchase was made on Dec 10 & just arrived on Jan 5th..

It took longer than expected to get here..

I was going to give her until the end of the week & then e-mail
that I was going to initiate a dispute & hope she will respond
so we can resolve this amicably.
 
I would file with paypal...she's really not giving you much of a choice. Time is ticking away and she is not responding. I have found that most sellers who ignore email messages do respond to the paypal case. I would go with paypal first and only file with your credit card if you don't get a good resolution from paypal.
 
Update: seller claims she never received my e-mails through her gmail account..

However, she had no problem contacting me when I opened a claim on PP

That e-mail she received..

In any event, we worked it out & let's just see if she follows through before
I close the claim...
 
Yes , I will & thank all for their helpful suggestions...

I won't close the dispute/claim until she does what she has said she will do..

Spoke with PP & they say that she has now 20 days to respond...

I think she will respond sooner as her funds are tied up...
 
Some sellers take repeat customers for granted and treat them less well than they'd treat a new customer. They assume their loyal repeat buyers will come back no matter what and this is what sometimes happens.

Absolutely so... & in this circumstance I absolutely agree.

She did not disclose all that she should have & because
previous transactions were so pleasant, I feel as though
she has taken that "loyalty for granted".

There is an old saying, first time shame on you, second time
shame on me.

If there should be any future transactions, I will know to ask
many more questions before I hand over my money.

But she has offered to make this "right".. so let's see if
she lives up to her end of the bargain...

If not that pp dispute becomes a claim & her $$$$ get tied
up until the matter is resolved and my cc will also work
with me. So right now, I am not terribly concerned...
