Cosmetics, 95% full is "NEW"?

I've found so many cosmetics listings that state "NEW" when they are clearly used.
How is 95% full "new"? Stuff like this really bugs me.

http://www.ebay.com/itm/It-Cosmetic...C-Cream-Foundation-Medium-OPEN-/252337679864?

I'm thinking these sellers are either reseller something they don't like after purchased, or they are dumpster divers selling cast offs from stores. Either way, if there's no seal and it's even 99% full, it ain't "new".

Thoughts?

My thought is that you should just hit the "report" button and move on. Not like you can do anything else about it but be frustrated....not worth the time in my opinion.

They have to choose New when they list because used cosmetics aren't allowed to be listed on eBay due to health and safety reasons.
