You can tell them what the reserve was and if they agree, you can list with BIN. Why not?

I don't think it would be violating ebay policy once the listing has already ended? IMO ebay doesn't offer much protection anyway and you can save on FVF fees that way. I would go for it if the winning bidder will pay the price you are after!
