Default Morbidly Obese Woman in Trouble for Murder

EDINBURG, Texas (AP) -- Prosecutors are trying to decide how to jail and bring to court a nearly half-ton, bedridden woman accused of killing her 2-year-old nephew.


A grand jury indicted Mayra Lizbeth Rosales, 27, on Thursday on one count of first-degree murder and on one count of injury to a child in the death of Eliseo Gonzalez Jr. She previously had been charged with capital murder.
Rosales weighs nearly 1,000 pounds and cannot fit through a door to leave her home, leaving prosecutors wondering how to bring her to court. As of Thursday evening, she was not in custody.


Hidalgo County Sheriff Lupe Trevino said that holding her at the county jail for her trial would be impossible because she needs extensive medical care.
"She would die," Trevino said in Thursday's online edition of The Monitor in McAllen.


The grand jury indicted Rosales after an autopsy confirmed investigators' suspicions that the child died March 18 because he had been struck. Investigators believe that the toddler was struck at least twice, crushing his head.


Authorities recommended that Rosales' bail be set at $150,000.
The boy's mother, Jaime Rosales, was charged with injury to a child because she is accused of leaving her son alone with his aunt. Her bail has been set at $100,000.

Although I don't know if it's fair to charge the mother as well, since I'm sure she didn't think this would happen.

If I was the mother, I'd be in jail for murdering the @%$^& that killed my child. She obviously wouldn't have left him there if she thought her sister would kill him. Why is she being held?

They can't hold her because she needs "extensive medical care"? Really? Was she thinking about her "extensive medical problems" when she was bashing that poor child's head in?

Sorry, I don't care how much someone weighs or how many "medical" problems they have, if you harm a child, you should fry.

The other thread on this story says "The child’s mother, 31-year-old Jamie Lee Rosales, was indicted on a charge of injury to a child for violating a Child Protective Services safety plan directing her not to leave her children alone with Mayra." - so apparently there was some previous indication that something like this could happen.

I also dont get why the Mother is being charged. If thats the way it goes, every Mother that has left their child with a Nanny that has been abusive to the kids(without the Mother knowing) should be charged! That is absolutely ridiculous!

As for the Aunt she NEEDS to be thrown in jail, who cares if she dies. Sorry, thats blunt, but come on, shes a kid killer!

The kid was 2 right? Still a baby. He could have just walked up on the aunt and was crying for something and she hit him.....she should rot.

Culturally, I think that view is growing in popularity, and in the next few years, there will, I think, be some very basic transitions and changes in the US legal system, in response to some of those changes in attitudes, opinions, beliefs - culture - of the US mainstream demographic, but as of right now, there are certain processes and regulations, etc that separate a suspect from execution.

In other words, it would be currently technically illegal for the police, or even court or sheriff's office personnel, to simply execute a suspect, regardless of method, without first going through the various legal processes of arraignment, trial, etc, and at this time, suspects still have the right to attorneys of their own. Granted, especially in the case of a suspect with limited or no resources, it is more of a formality, but there are formalities - complete with forms that must be filled out, even though those processes are decreasing in popularity from the standpoint of mainstream public opinion...
