I'n just sick that court is reccessed until after Thanksgiving. Had Mark not taken the stand in his own "defense" (AKA Another of his lying times) this would all be over by now. Ever the control freak, his delaying tactics has only served to make this as difficult as possible for all concerned.

A correction I must make, since it bothers me a lot... the children were a girl AND a boy, not two boys. I went nuts emailing all the newspapers who'd published that Devlin was a boy. Most didn't reply, but the San Francisco Chronicle did, and they tried their best to fix it. I know Devlin isn't a proper female name, but you'd think they'd check and make sure they had the gender of the children right. I'm also appalled that some papers published a photgraph of the car with the yellow tarps covering Devlin... there is no need for that, the story alone was horrific enough. I wonder if the papers even think that perhaps family members may view this? Obviously not.

Again, thanks for all your prayers and well wishes. When I see Erin at Thanksgiving, I will tell her of your words. I swear it's been the kindness of strangers who do think of our family that had pulled us through the last four years. I cannot thank you enough on her behalf.

Just as soon as I hear the verdict, I'll post it here. Henry Lee of the SF Chronicle gave me his cell number, I'm to call him too so he can publish it.

I actually saw the aftermath of this accident, as I was pretty much stuck in the traffic.
It was horrifying. I'm glad to see justice finally happening.

ColdSteel, I have corrasponded with several people who saw the result of Mark's rage, they were just so sweet. I've also read blogs of people who cannot pass by the area without thinking of what happened. I've tried to convice one of the other aunts to stop having a memorial service at that spot on the annivesary of thier deaths, it's just re-opening an old wound. I guess some people just can't let things go. But this year she will find herself there alone. The other family have decided to do something pro-active, and campiagn to get Domestic Violence laws changed. If anything, give Devlin and Daelin's death some meaning.

Again, this was the end result of a man who had a severe problem with committing domestic violence. Just in the last few days here where I live (not near where my neice was maimed and the kids killed, I am about 100 miles from there) we've had three women shot and killed by their estranged spouses. The laws MUST be stricter for perps of DV, the current laws and lax attitude of the courts are NOT ENOUGH to protect the victims. Sadly, in our case, the victims of his rage was the most innocent... the children. And Erin will forever have the scars and memories of what he did.

I beg each of you to write your congressmen and governors to PLEASE do something to stop this epidemic of wholesale murder of women and children. The only mistake Erin made was loving a man with problems. And she's paid the ultimate price for it. He'd been arrested many times, but each time he made bail and was out on bail, allowed full access to his son, at the time this occured.

Yes, justice will be served. He will probably never ever see the light of day again. But the scars will never go away for my family, or his. I am left to wonder if the outcome would have been the same had the courts just said he had to totally stay away from Erin, instead of allowing him half custody. It's not come out that I know of, but Mark's attorney for the child custody case had threatened all of Erin's family with jail if we didn't tell him where Erin was. With this, the restraining order was pretty much worth nothing.

Sorry if this seems a tad scattered-brained. It's late and with Thankgiving coming up and I had so hoped the trial would be over with by now, I am not thinking 100% right. Thank you all for your well wishes. You have no idea how much I appreciate the posts here.

I hope that you can find some peace and have a good Thanksgiving with your family... Just know that there are many of us who feel rage at this man who took so much from you, and that he will get his, in due time.

Thank you from the bottom of my heart for these words Glamfoxx. This forum has been healing for me in many ways. Just allowing me to tell you all about the kids and my niece HAS helped me heal. Tomorrow, when we go over to my mother-in-laws (an incredibly strong 77 year old!) I will be sure to tell my family about the beautiful and gracious people here at the Purse Forums. Erin will be pleased to know so many MORE people have thought of her.

And as Roo said to me in a PM, who knows? All us females in the family may just get into designer purses now!

It will ImaSadGiraffe, it will. I am positive he will never breath free air again. Thank you for your concern. Karma IS a bitch.

I'm rather upset with Erin's "mother". (NOT my Sister in law, she's her step-mother.) "R" gave Erin a guilt trip and begged her to spend Thanksgiving with her instead of up here with her father, my BIL. When the girls were little, R was always begging my BIL to take the kids during all the holidays, and she'd stay home and get high. Erin was supposed to call me, but R wouldn't let her because it's a toll call, never mind I told Erin to call collect.

I couldn't go to Mom's for dinner and now I hear it's a good thing I didn't. Apparently Mom stood up for "R" and upset my SIL, who's been the only stable mother figure in the girl's life. I don't need that right now. I love my MIL, but I also love my SIL.

I hate holidays.

Found out Tuesday that the jury has decided on all but ONE count. Mom J is who called me, and she's 77, so she forgot WHICH count is was. I am assuming it's the most difficult one, deciding on first degree murder or manslaughter. The problem they are faced with is Mark's intent, did he intend to kill the kids, and his attorney and most of my family agree that he didn't mean to kill the children, but he had to have known having gasoline and two lit cigarette lighters could hurt someone. But INTENT is what they go on.

Soon, soon I should be posting he's guilty on all counts and they say right after they get the verdict, the judge will hand down his sentence. Of course, his lawer immediatly files an appeal, more waste of time, but he'll be in a prison for that. and he fears prison the worse.

As soon as I know, I'll post!

Thanks Pukasonqo!

I'm not real sure how the appeals proccess works, and I just don't get how he could even consider filing an appeal, although I understand if they do give him the Death Penalty, it's automatic. I also dont' know how MANY appeals he can file in the State Of California, I just hope it doesn't involve having to drag my family through courts again. If anyone knows how this works (hey, I'm an artist, not a lawyer!) I'd apprecate a link or a quickly note here about it. Thanks!

Mom called. (My MIL, I call her Mom since my own mother passed away in 2000) One of the jury memebers was excused for talking to my brother-in-law early on during a break, so he was replaced with an alternative. Now they have to start deliberations all over again. They have decided (unknown as to whether it's good or bad) on all counts except one, the Aggravatted Mayhem charge.

This angers me that they just NOW bring up that Bob talked to a juror (not about the case, I have no idea what it was though) and are taking jurors off. They are not sequestored, so as far as I know, one of the jurors could be reading this. Lord help us, I just want it all to be over.

im from the east bay and i remember when this happened, it horrifies and disturbs me as extremely today as it did when i first heard about it. i can't even fit into my head that human beings are capable of such things. it renders me speechless, at a complete loss. i also can't imagine the level of grief this family has gone through. any excuses made for this absolute DEVIL of a human being just will not float. no amount of punishment is enough because it'll never reverse what happened. it's all so sooo much to bare, all my most positive vibes and wishes of strength go out to your family, speedy. especially your niece, for the physical pain she's sufferred, and more importantly, the pain of losing her children, and in that way. tell her i send her my love, ok??

i believe everything gets balanced out in some ultimate end. if he doesn't pay for what he's done via our justice system (and how can he? jail is nothing compared to what would be "fair"), even if he doesn't pay for it in this lifetime...eventually he will. he'll have to answer for this somehow, someway.

^^^^ Yup, I so believe in Karma, and it will get him in the end.

Nothing new as of right now. Court is only Tuesday through Thursday, I expect to hear from my SIL or MIL tonight. But now that they had to re-do the original deliberations, I have no idea now how long it will take. And it's killing me to know they decided on all but ONE count (out of 7 I think) when they discovered one juror had said "hi" to my BIL four weeks ago.

Pure bull***t. I know they are grasping at straws now, but come on. As hard as it is for us, I can't imagine what it's like for those jurors. Bless them though, I am sure the re-embursements are nothing compared to the emotional price they are paying.
