Default Reporting stolen pics to ebay!

So a couple of days i'm thumbing through auctions and I came across this one.The seller had the reputable seller Fashionphile photo of a Gucci tote listed on their auction
http://cgi.ebay.com/ws/eBayISAPI.dll...Sort%26fvi%3D1

so with things not adding up I notified eBay.This is what they wrote back to me.

Thank you for writing eBay in regard to your report on image and text
theft.

I reviewed your information about the possibility of image and text
theft. At this time, I didn't find sufficient evidence to show that the
member has violated any eBay policies.

Please understand that in some situations members will allow others to
use their images. It's also possible that the members acquired the photo
from the same source or a source that we can't verify. If this is the
case, eBay can't remove the listings.

We will be able to take action only if the person who owns the image or
text writes to us directly. If you feel strongly about this issue, I
recommend that you contact the seller, informing him or her about your
concerns and recommending that he or she contact eBay. Once we hear from
the seller, we will then take the appropriate action.

It is my pleasure to assist you. Thank you for choosing eBay.

I don't understand.Did I put it under the wrong complaint or does eBay not see this?I think if it was from Fashionphile it would of clearly stated that they have another ebay id.

this really discourages me from report stuff like this.

You should contact Fashionphile about it. Unfortunately, they usually do not do anything unless the person whose photo was stolen reports it.

Hi! Yes, always a good idea to watermark your photos. Even the watermarked ones get stolen, like this one, but it will be easier to show it is your photo and may discourage some from stealing.

I use my photo editing program and use text write tool to write my name across picture. It's not hard to do.

I had my picture stolen once and i contacted the seller right away with a nasty email! I then reported it to eBay and they needed me to PROVE to them that the photo was actually mine. I was more than happy to provide them with my auction listing and they said they handled it and due to privacy policies, they would not inform me what actions they took upon the perputrator.
