Default Would you let this go, or keep bugging the seller?

This seems like such a petty problem compared to some of the more expensive ones in here but anyway here goes!

I bought a bag to take on holiday a couple of weeks ago, nothing expensive by any means. I think it ended up costing £15. It's a black and white flowery bag with some beads and sequins stitched on. I noticed when it arrived that they were stitched on with red thread, I thought it was a little strange but didn't worry about it.

I took it away last week and at some point it must have got a little wet because next time I looked at it, half the bottom of the bag has gone pink. It's lucky none of it got onto my clothes or it would have been more expensive.

I've emailed the seller and she's basically just brushed me off, saying she's sold 30ish of these without any problems. There was no indication of resolution/refunds. I've emailed her back saying does she want me to send it back so she can return it to her suppliers but I'm not optimistic. Of course I'd already left positive feedback when it arrived so I'm pretty much stuck.

What would you do? If she ignores me again the most I can do is leave some follow-up feedback, but it won't affect her score. It's the principle that annoys me, I only used the bag two or three times and now it's ruined!

Unless I am missing something in your post, why would you even bother your seller with asking for a refund for a bag that *you* damaged?!

I didn't damage it though! Surely you can expect to take a bag out in the rain without the colour running everywhere?

I don't take every bag I own out in the rain. Sometimes fabrics and colors run when they get wet. It not your sellers fault the bag got wet after you used it two or three times. If the bag arrived in this condition, that's one thing. She would be 100% responsible. She's not responsible for damage resulting in how you care for it after you get it and use it. And I'm quite sure there was no indication of resolution/refunds in her auction terms because she is not a store like most sellers on eBay. Offering the same customer service policies as a retailer is out of the question for most sellers who do not use eBay as a business.

Maybe you can take the bag to a reputable cleaners and have it repaired?

It's not her fault it got wet no, at the same time it's not my fault the colour ran, and now I have a bag I can't use.
She actually is a business seller, with a shop.

^^ If she is a business seller she should take it back, if you took it back to marks and spencer they would refund you, it's faulty if she didn't tell you it couldn't get wet, if she doesn't reply to you i think you are going to have to let it go, however annoying. if she wants to be a business she has to adhere to your statutory rights as a consumer.

I totally agree.

The seller said she sold 30+ of these bags and that sure sounds like a business seller. She should at least take it back to examine the damage and then work something out with you.

If she has a business then it would be *nice* of her to accept the bag back and replace it or refund you for it. But she is certainly not obligated to do so. eBay does not require that anyone offer a return policy on the items they sell.

It wasn't dripping wet no, in fact the top part is still white so that must have stayed dry. I did think about soaking the whole bag in the sink to make it pink all over - except then I'd have to carry it at arms length the whole time or only wear it with black in case any more colour came out!

They do in Germany and I think in the UK, too. If you have a business you have to accept returns and offer a warranty.

yeah in the UK when you sell anything you HAVE to offer a return policy. She should be able to return it to her supplier - however if she dosnt reply to your emails there isn't a lot i can think of that you can do :( x

i'd probably let it go and just leave the follow up feedback for the sake of £15, you win some, you lose some, especially on eBay

She has a return policy, but it's within 7 days. I was in Spain at the time so there's no way I could have posted it back to her.
I'll keep this thread updated if she comes back to me again.
