Default Would this qualify as identity theft?

I, used to be a seller on eBay in electronic accesoiries espacially for ipods. Now there's a very big problem, someon in my neigbourhood opened an account, over my ip, under my name, my adress, phone number etc. He/She also got the registered cc with ebay and put that on his own account, to verify his ID, he also has my ID-card, but with a different Day of Birth.

If that's not all, he also listed tons of counterfeid goods on eBay, which got his account blocked, now the worst problem, my account got blocked too, I can't make profits anymore and can't finish the sales I started.

Now my question is, can I report this to the police, because it's not that big in a way that he's stealing a lot of my money but still he's screwing up my reputation as thrustworth seller, and I need t oconvince eBay this actually happened, because the ip is the same as mine, so they can't just block that account.

this is frustrating

I'm not entirly clear on the circumstances. If somebody pretends to be you to make money or steal money, then yes that is identity fraud.

Have you taken any other steps at all the get justice? contacted eBay or paypal (if they are involved) and your CC company?

Contacted eBay, accoring to live chat I had to mail teh trust & safety team, did that but they're backed up because of the stupid 30 day selling restriction. Contact my CC company, and told me that no charges were made, but still blocked the card and requested a new one. paypal is not involved (thank god).

But this person was smart, because it wasn't them to do about my CC, because they make more money selling fakes on eBay and if ebay didn't get so strict after the LVMH debacle, it would have never been noticed he used my ID to sell fakes and I would be responsible if people complained about it to ebay or my cc company

Oh i see - so you don't use your ID anymore, and it has bascially been hijacked.

Im really sorry this happend. Hopefully eBay will be more helpful once they aren't so busy. Keep contacting them until it is sorted, dont give up hope! They can be very lazy with their corresponadance so make sure you keep on their backs about it. x

Yeah, but the problem is the seller has everythin including my social security number so s/he an still fo whatever they like being me

I would report it to the police. He pretends to be you and he already harmed you by listing counterfeit goods under your name, which got your account closed, too.

Our modem got attacked all the time by viruses and trojan horses etc... a while back, I think that's howhe got the information. Now we have a new modem, but he still is onlin over our modem, bacause accordign to eBay, the person who logged in was on my IP, and Idind't knew the account existed till this morning.

Oh wow, this sure sounds like something you need to report to the police. How horrible. These are some serious things and I don't know what could happen if you know about it and don't report it. I mean in case he defrauds other people in your name and you didn't do anything to prevent this.

I found out this morning and just went to the police, but they can't do anything about it because he accesed my modem and used that to list everything and used my ip, which makes it impossible to find out who he is. But it did give me security that I can't get charged with a criminal offense or sued, now I just have to find out what to do if someone want's a refund and how I can get my identity back, because he still knowseverything from me my social security number everything

You need the Microsoft Defender installed on your computer - can help with the trojan virus. MS defender is free - from MS.

You might also want to save all important information that you have on your computer onto disc and then reinstall all MS products (silly me - pending that you computer is all MS)

We did all of that but they hacked into our modem, and disabbled the modem firewall which made it easy for them to get everything they wanted, but it took the ISP 4 weeks to find out what was going on, and another 3 weeks to decide to give us another modem with a new IP, which they have hacked AGAIN

I think it's time to buy a new computer and new modem.

Question

Is this all currently happening in The Netherlands (as indicated in your location) or is this in the USA?

(I was a victim of identity theft several years ago...and the process of 'cleaning up' the mess can be quite lengthy & stressful.)
