This is precisely what I was referring to in another thread.
I just got this message from a seller. Help!

Let me guess, this was an off-eBay transcation, right?

The buyer COMPLAINT policy that covers off-eBay transactions covers delivery of goods and they don't investigate claims of SNAD. So, a seller could send you a coat with the wrong measurements or a pile of dirty underwear and you have no recourse with Paypal a long as the item is confirmed delivered.

DId you fund the transaction with a CC, file with them instead. You may be successful there.

I am giving my above opinion from reading similar posts here in the eBay forum and from reading the user agreement. I have no personal knowledge as a buyer or seller of a Paypal claim for off-eBay transactions.

I just had the same thing happen with PayPal. They SUCK. I took all of my credit cards off PayPal, told them off and contested the charges on my American Express. Mine wasn't an eBay purchase, from a website that sent the wrong width collars for my dogs. PayPal makes me sick. I should have been suspicious of the website when they only took PayPal and not credit cards directly.

Wow, this sounds like a cash cow! We could advertize virtually anything for sale, send out packages of dirty socks, (I hate doing laundry, what a great idea) accept only Paypal as a form of payment, and of course, be sure to ship everything with delivery confirmation. We could make a quick million!

Now you all know why I closed my Paypal account last Friday. I like Paypal about as much as I like eBay, which is not at all.

Buttercup, read my other response about the buyer who re-sold a pair of Steve Madden's that the new buyer is claiming are fake. (Fake Steve Madden's, you've got to be kidding???)

No sale on eBay is ever final!!! Send it back, file a Paypal claim and respond that it's already been returned. Money back, problem solved. If it's an off eBay sale, use only a credit card for payment - NEVER Paypal.

Yea, but do you mean pay with Paypal using a credit card or just to use a credit card? I would never give them my CC #.

If this was in fact an eBay sale, which it sounds like it is due to you mentioning the seller's Power Seller status, then fax a letter to eBay. In your fax include a description of the problem, a printout of the auction showing the seller's stated length measurement, and a picture of the coat with a measuring tape measuring it to show that the item you received is not the item you paid for.

Several years ago I purchased a fake Chanel. The pictures online looked good, but when I got it there was visible glue on all of the seams. Not believing that I should have to pay to authenticate such an obvious fake I did exactly the above. Claim won, no questions. A picture can be worth a thousand words.

I would pay via Paypal with a credit card. The Paypal claim process is fairly simple (unless it's "toss a coin" day at Paypal to see who wins claims), so it's usually easy to win a claim, at least it used to be.

Hi all, thanks for your replies- here's the update (sit down bc it's unbelieveable).

Since you purchased your goods independently of eBay or have not marked your goods as eBay items while paying through PayPal, we are not able to investigate your claim. This is because we are unable to compare pre-sales and post-purchase descriptions of the item.

OH-MY-GAWD

I cannot believe it. This is a payment I made for an eBay item, using EBAY'S CHECKOUT SYSTEM with my Paypal account.

To this point I think that either I completed the claim the wrong way or however's on charge for claims is smoking something.

I am going to make another complaint against eBay tonight, I will keep you updated.

No, it is not. As I said it is a 100% eBay transaction using Ebay's checkout system.

Ahh... well then there is definitely some error in their system because they are treating this like an off-eBay transaction.

I think your best bet is to call and actually speak to someone to make sure it is processed under the buyer protection plan for eBay purchases.

I didn't see this anywhere earlier in the thread. The wording was cut & dry what they tell people for off-Bay transactions. On your Paypal transaction does it list the eBay listing number anywhere?

Thanks for your response. I did read your post and I feel for you. I also thought it's a bif unfair for Paypal to allow that kind of thing. My coat cost around $70. It's not like I'm trying to claim thousands back like the person who's ripping you off. I hope everything turns out fine for you.

EDITED: sorry I assumed the "power seller" thing etc was clear. I'm sorry if that sounded abrupt -it wasn't my intention. I'm in the verge of desperation. I do appreciate all comments.

Ugh, I'm so sorry you're going through this. Like a PP said try calling to see if anyone can help you on the phone. But from what I'm reading, don't hold your breath.
