Default What's the chance of me getting my money back?
Hi all,

I couldn't find my last posts so long story short, I'm in the process of filing SNAD with paypal (of a pair of fake shoes) and they have accepted my authentication statement and now they request me to send the shoes to them. UGH, $60 of postage out of my own pocket. Fine, as long as the shoes don't go back to the seller.

My question is, what is the chance of paypal refunding me full amount? Will I still be getting money if the seller has withdrawn all the money or closing his paypal account switching to another one? He's still selling on ebay, so does the chance look good?

I just don't want to be out of $60 postage and getting nothing back. Any input is greatly appreciated.

I just got a new email from seller as well...

Hi Cindy,

My attorney will write today the letter to PayPal legal department to provide me significant evidence or proof so the shoes are not Authentic and reason why I am doing that because I have the store in Boston (Lestrada.com) and I go to Italy every 2-3 month and all my merchandise go trough US customs , so if you are right and the shoes are fake first I am not going to deal with this factory and by providing the proof I will get my money back., but I almost certain the shoes are Authentic because this factory do the work for Prada. Because I am buying a large stock some times you can find some small defect on the shoes (they are human) so I send them back to Italy and they are exchange them for me, but not to be Authentic it is very strong accusation .I offer to work out deal with you like I do with all my customers and you decide to go with the PayPal I don’t know why.

Does everything sound logical to you guys? Can this really be an honest mistake? Should I still leave neg FB? The shoes are FAKE tho, I've had them authenticated here and by caroldiva.

If the seller has a feedback over 50 and is still selling you should get your money back. I did.

Go with your gut and what you know -- the shoes are fake. Anything the seller says to you should be suspect. "A factory doing work for Prada" is not Prada. You opened the dispute with Paypal so I'd let them take care of it. In the end, I'm sure you'll get original price & shipping -- not authentication or shipping to paypal costs, tho.

I agree with Regina. I may be paranoid, but I am sick of excuses by sellers of knockoffs. I have not encountered a single one who admitted they sold a fake. It is always someone else's fault, usually their "supplier." I would like to give some of these sellers (I am a seller also) the benefit of the doubt, but it is difficult. I am thrilled for you that you will get your original shipping and price paid for the item refunded, and sorry that you have to pay $60 out of pocket to ship the shoes to PayPal. Sometimes, PayPal will allow you to just destroy the item. As to negative feedback, that is your call. I hesitate to give anyone a negative, but if this seller is going to scam someone else, it is probably necessary.

I emailed paypal and ask them if I could just destroy the shoes myself, I even can send them HD video footage if they like. I already paid for authentication statement and really don't wanna lose more money over something that is not my fault. (Item was $350 and I will be losing around $90 altogether if shipping it back to paypal. stupid isnt it?)

Let's see what they say...

Honestly they don't deserve to get hands on your authentication statement either unless they are going to pay you $ for that for them to use it for their own goals.

Cindy, please let us know what they advise you to do. The video footage is a fabulous idea! They had me destroy an item and took my word for it that I did so, thank goodness. It was the worst fake Chanel I could ever imagine, and it smelled like a mixture of horrible chemicals - it actually made my eyes water when I opened the box. I was afraid to burn the bag because I thought it might explode, so I marked all over it with black marker (the bag was a pale pink bowler), cut it up and tossed it. They are supposed to let you know that in the U.S., it is a federal offense to ship a fraudulent item through the U.S. postal system. Have they told you this?

No, they haven't told me that they are trying to get me to break the law.

I wrote to paypal and explained how I wanna destroy the replicas myself since postage is expensive. They wrote back and said, send the shoes to us and we'll give you a full refund. WTF.......didn't they read what I wrote? So I replied to them saying that read my message again. Now my request has been "forwarded to relevant department". I'm still waiting for their response. I'll keep you guys updated.

Mail the shoes into the address paypal provides. They have been doing that on a case by case basis. How much buyer protection was stated on the right side of the auction?

That is a standard email I think. Looks like you will have to send the shoes back. Its not ideal but at least you are getting most of your money back

I just called paypal and spoke to an extremely helpful lady. I quoted jjyounger about sending replicas being a federal offense. She put me on hold for 5 mins then told me it was all good. I recieved an email from paypal saying that I could destroy them on my own (finally!), after running in circles for so long this is such a relief.
