Exclamation What should I do ?? A NO win situation ?

Hi, I bought a bag off eBay, usually I know what Im buying but the bag was advertised as LV bag, and looked real from the pics. So I asked the seller if she would do a BIN and I offered a lowball offer which she accepted.

The bag came and at first I thought it was real (its an LE, very rare and not seen often) so I had not seen pics of the bag. Then I thought I would get it Authenticated because something looked off with the hardware, so when I got it authenticated I was told that it was fake.

I e-mailed the seller and made a dispute, I thanked the seller for her quick post of the bag and her communication but the bag was fake and I would like a refund because it was illegal to sell a fake.

So the seller was less than co-operative and didnt want to give me a refund until I escalated the claim. Then today I get an offer of refund which I took, does this partial refund mean I send the bag back or not ??. If I send it back I lose money, if I dont then she does. What should I do

What do you mean by "partial refund?" Did she refund all but the shipping, or some other amount?

she refunded all of the amount -postage. eBay isnt saying anything about posting the bag back, they said the refund should come through soon. Does this mean the seller wanted the bag back and should I send it ??

Yes, what is partial? I would not accept partial refund for anything non authentic under any circumstances.

OK, I would ask the seller if she expected the bag back and she does, for her to refund your shipping fee, that way, you are not at a loss of round-trip shipping and she is out of nothing. You split she shipping fees.

^agreed, tell her to refund the shipping TO you, and you will pay to ship TO her...wait till you get the $$ though...(just in case...usually they make you send back first, but if she is refunding now, that's great!)

Of course if it is fake and she sells lots of fakes, she may not even want it back...or care.

BTW, if you paid a high shipping, for international or something, I would make her pay all the shipping both ways...

Thanks guys for your responces, I really didnt know what to do.

I paid just under $30 shipping and I really dont want to be out, so Im going to e-mail offering to either dispose of the bag or return it to her for the shipping price.

I know it's the principle of the thing, but I'd probably just send it back and be out the shipping money at this point, particularly if it was a quite expensive bag. I'm not sure that that's a battle I'd pick.

Thanks for your replies, I have e-mailed the seller and asked if she would like me to dispose the bag or for me to send it back and she can pay for shipping, since I had paid to have it shipped to me and have not been refunded. The bag was under $200. :)

Socialite, contact eBay. They should be the only ones to direct you on how to proceed. Chances are with the threads we've been seeing as of late, they will probably want you to ship the fake bag to them. I also would not accept anything short of a full refund, that includes shipping.

Please let me know what eBay or paypal instructed you do do.
I would NOT send that bag back to the seller, just so they can resell it, to someone else. You shipping a counterfeit bag, across state lines is a criminal offense, I think, Isn't it?

I've seen a couple girls over the past couple months, that this has happened to and they are sending the bags, to the FBI.

eBay instructs buyers to send the fakes to a paypal returns address and this is a reselling company, who resells them and then pays ebay for it.
