i skimmed thru all the pages of this thread and was shocked to see the scumbags out there but so impressed to see all the detective work abilities of you amazing tpfers! i have a huge favor to ask. i too was just scammed by someone, and was wondering what steps i should take. my guy appears to have just been sentenced to 2 yrs of prison for fraud :( i've disputed the charge with my credit card company, tried to alert google checkout, restricted the guy's account on paypal, and am planning on contacting the police. the thing is, because i paid him on friday and he was sentenced on monday, i think the funds might not have been w/d from his bank account, but i cant get anyone at google checkout to address the issue in a timely manner. clearly i'm panicking and would greatly appreciate any help. TIA!

A small claims is a civil lawsuit for $$$...when someone files bankruptcy, they're asking the court to absolve all or some of their debt (this includes Small Claims) OR asking that their debt be consolidate to a certain amount they feel they can actually pay off (this would mean you turn over any cars, homes, furniture, etc. you own...things that the court deems unnecessary to lead a 'normal' life...by 'normal', the court means you can take public transportation to get to work, you can possibly keep your home OR you could rent, etc...the bare necessities).

During the process of bankruptcy, the court sends out notifications to all people (the creditors) that are owed money by this person (the debtor). The creditors have the option to list themselves as people who DO want to collect some type of money; government agencies & financial institutions get 1st dibs on any money this person might have, IF there's any money left over, then the "little people" get paid off, if not the debts get cleared.

There are some bankruptcy process that clear ALL debt...depends if the judge deems the case worthy enough.

Thank you SuperChica. I forgot to mention that there was a finding of "no assets," meaning that she owns nothing of value with which to pay creditors. She will be discharged, free and clear. I guess they missed her Bal bag stash.

Well I certainly hope that, while she was still found to have "no assets", a criminal case is pursued above and beyond this. Claiming bankruptcy will not clear her of that criminal, fraudulent activity.
