Oh and this really upset me also. Last night, eBay's VP of Trust and Safety, David Pride, made an announcement about the LVMH lawsuit. Part of the text was: "While recognizing the importance of fighting counterfeits, we do not agree with overly broad attempts to protect uncompetitive commercial practices of authentic items at the expense of consumer choice. This threatens the livelihood of our law-abiding sellers and the ability of our buyers to get great deals. Overzealous implementation of restrictive sales practices are anti-competitive and give you, our buyers and sellers, a bad deal."

I wasn't sure whether to laugh or cry when I read this.

I'm afraid eBay itself is overzealously implementing restrictive selling practices by creating arbitrary limits that don't appear to take into account seller reputation or behavior.

I read through this entire thread before posting, just to see if what I had to say had been addressed yet, but it hasn't.

I've been selling on eBay since 1999, am a Bronze Power Seller and have over 1400 feedback, currently at 100%. I primarily sell Louis Vuitton. I have only listed one item so far this month, and edited the auction repeatedly (lowering the BIN) before it sold. I probably edited it about 5 times. I still haven't received the 30 day message yet, but that's no guarantee that I won't eventually.

My question to you all is: About 18 months ago eBay did this same thing primarily (perhaps exclusively) to sellers of Louis Vuitton. It was in December of 2006. I remember because I emailed to have my account limitations lifted and after a few days they were, and I've never had a problem since. Was anyone here affected by the first limitations they put on LV back in 2006? I'm just wondering since I had the initial restriction listed long ago, maybe that I'm already cleared through this one? I'm sure I would be restricted from listing other brand names, though.

Also I would like to say that not only am I a seller, I am a big-time buyer. eBay has been so concerned with the needs of buyers lately they seem to have forgotten that some of the biggest buyers on Ebay are also sellers/resellers. I can't possibly afford to buy luxury items on Ebay if I am limited as to how many I can sell to finance my future purchases. So in imposing these restrictions, Ebay is not only losing sellers and their fees, but the buyers as well.

I don't believe that even eBay believes this kind of intervention will work or curb the sale of fakes. Even with all of the current limitations, I see plenty of fake auctions. Ebay is just doing this so when the appeal against LVHM comes up they can tell a court that they showed "due dilligence" in attempting to remove fake listings from their site.

This may be unethical to some, but I ended up posting my Dior bag under my fiance's eBay ID. His feedback number is higher than mine (though we both have 100%). However, I couldn't revise it. It's just annoying since I keep having to bother him to see if any potential buyers are emailing me about the bag.

I'm just a casual eBay seller and buyer with 100% feedback and I got the 30-day listing limits notification when I was trying to re-list a new full size Estee Lauder lipstick and a M.A.C. eyeshadow on Sunday. I have the receipts for these items and I have contacted customer service twice within the past 72 hours as I was initially promised a 24-48 turnaround time on the decision if the limit was going to be lifted. Last night the customer service rep "escalated" my claim and notified me that the Trust & Safety team were "currently backed up with these requests at the moment which is why the decision is delayed".

It's been a week since I emailed eBay. I thought I was going to get the "no" you gotta wait 30 days but surprisingly today morning I got this...

This sucks. I can't find the form to email eBay about this, can anyone post a link?

Also, is there some sort of "list" with the brands that have these regulations?

I just spoke to the Gold Power Seller rep once again. I specifically asked about those who had received the notice to send another request in 90 days. I was told that regardless of receiving that notice, in 30 days, you WILL be able to list again. You may still have restrictions in place, but if you only sell several bags a week, you should have no problem. This may give those of you who have received that horrifying answer some hope. She once again said that this is random, site-wide, and has been in the works for some time, long before the French court decision in favor of LV. I do believe this is eBay's misguided, fumbling attempt to deal with sellers of counterfeits. Unfortunately, those of us who sell only authentic bags were caught in this mess as well. But cheer up - if you received the 90-day notice, THERE IS HOPE! You may list your bags again in actually fewer than 30 days.

jj that is good news! I am also a powerseller, with 100% positive feedback. I sell mainly Chanel, Balenciaga, Coach and some LV and was blocked. Do you have any idea of how many we will be able to list after 30 days? 3?

Well, I told her that I normally have 3-6 Chanel auctions per week, and she implied that that number would be no problem after 30 days. Actually, it's now probably about 23 days.

I hope it's the same case for me. I am having a very difficult time getting answers from them. They are telling me since they are not the department that places the restrictions that they really have no idea..and to wait and see. Well I am not going to buy a thing until I know I can sell and how many. It would be nice if they told us this when placing a restriction on us. ahhh!

I just clicked on "contact us" link to lift the restriction.. You'll see it when you try to list the item but eBay won't let you. That's where I contacted ebay.
