Default STAY AWAY FROM eBAY SELLER kathleen_lcmt!
Hello Ladies --

I am starting this thread just to warn all of you about an eBay member (seller in this transaction) kathleen_lcmt . I also would like to find out if anyone of you remember dealing with this member. I would really appreciate all the information you can share.

It all started with this listing on eBay Item # 300359090630 BALENCIAGA Work APPLE GREEN Excellent RARE COLOR

I messaged the seller inquiring if I could do a BIN for the asking price? She agreed to it quite readily. I didn’t see any red flag there as this has been relisted because of no buyers. I thought she was just desperate to get it sold. So I agreed to send payment of $799 to her PayPal account that same day, then she would pull out the listing. In the evening of October 20, 2009, I transferred the agreed amount to her PayPal account. She then pulled out the listing from eBay promising to ship the item the following day.

So when it arrived on Nov. 2, I was very excited to see the bag but to my dismay, there staring at me packed in the envelope was a RED BAG (not the green one I bought)! So I carefully examined it and took some pictures so I could show PayPal and the credit card company that I did not receive the correct bag.

The tag said Balenciaga. But after more detailed examination of the bag, I found it to be a very bad FAKE or COUNTERFEIT! I am sure you can imagine my anger and frustration at this point. So I emailed her a stern note informing her of the delivery of the package and told her about my findings, I even sent her the pictures that I took.

On the same day I also filed a dispute with PayPal but the seller escalated it to a Claim. Here’s the exchange:

11/4/2009 09:31 GMT-05:00 - Seller: I just spoke with one of Paypal's reps regarding this situation because I am extremely upset over these allegations. This is an absolute untruth, and I feel communicating with this buyer any further will be of no help at all. I wish to escalate this matter to a claim and let Paypal handle it. Thank you, Kathie

11/2/2009 14:37 GMT-05:00 - Buyer: I just received the bag I bought and paid for and to my dismay, it was a totally different bag! I bought a GREEN BAG and received a RED BAG AND TO TOP IT ALL, THE RED BAG I RECEIVED IS A DISGUSTING FAKE!!!!! I WANT MY MONEY BACK!!!!!! I AM SO DISAPPOINTED! PLEASE DO THE DECENT THING AND RETURN MY MONEY AND I would like to return this UGLY AND FAKE BAG! YOU CAN ALSO PAY FOR THE SHIPPING BAG! This is totally not acceptable!

IN MY HONEST OPINION – the seller was well versed in PayPal’s policies, as she mentioned that “I'm just trying to follow all paypals guidelines” when she messaged me about shipping.

The final word from PayPal was:

Status

-- We're unable to decide this claim in your favor at this time. PayPal's Buyer Complaint Policy applies to the shipment of goods but not to disputes about merchandise quality. --

This is the reason why she decided NOT to entertain my email to her and just go through PayPal and escalate the claim. Because she knew that by doing this PayPal will have no choice but to CLOSE THE CASE. This of course means that she did not have to refund my money because PayPal will protect the seller in this situation.

My next attempt in getting back my money will be with the credit card company and the seller’s local POLICE DEPARTMENT in Attleboro, Massachussetts (fingers crossed).

But above all, I just want to warn everyone about this seller, kathleen_lcmt (eBay member registered in Newport, RI, United States).

OMG, wow
Sooooo sorry OP.

Unfortunately PP will only do INR disputes (in which the item never arrives at your house) and not SNAD when it is not purchased directly through Ebay.

PP is awful if it is for a non-ebay purchase

Definitely dispute it with your CC!!!

I am so totally unsure why this sort of bait and switch isn't covered with the policy? Seriously?! WTF?

did you pay via credit card through PayPal, I do that and then mastercard, even better AMEX take better care of the case...in this case you did not get what yo payed for, even just the color is enough for claim

I would also post this in the ebay subforum as the girls are very knowledgable there.
Is there any possibility to do a chargeback on your credit card?
It also seems odd that she sold bags before without incident

Oh my gosh I am sooo sorry!!! I hope not only do you get all your money back but she sees a police officer or 3 at her door.That is sooo WRONG on soo many levels!!! What she and PP is thinking WTH????

You certainly received a disgusting fake. So sorry this has happened to you and really hope that you can get your money back. As previous posts have said the best way to seek redress is by doing a charge-back on your credit card. Please let us know how it goes. Best wishes.

Sorry this happened. I have sold a few things and bought a few things that I or the buyer have requested to do a BIN and I just edit the listing and add a BIN, or have them add a BIN to the listing so I am protected.

Horrendous.. so sorry to hear about this and hope that you are filing a claim with your cc company.. as soon as they see her listing for a green bag and you got a red one,
you should be able to get your money back. Shame on her and thanks for letting us
know about this unsavory character.

Couldn't you call PP and speak to them directly? This is so horrible. So sorry this happened to you. Can you also alert ebay to this? She violated by selling off line also, even though she agreed to a BIN.
