Default So Angry Right Now!!!!!

I am just beside myself!!!!!! I bought a valentino maison pintucked shopper off eBay 3 weeks ago. The seller had been registered since 05 but only had 6 feedback, all positive. And the bag looked great so I won it for $468.12. The item location stated that it was located in Brooklyn, NY. I paid right away with paypal and a week went by with no shipping notice so I emailed the seller through ebay and got no response. So I sent an email to the paypal payment address that was listed on my payment details. Got a response right away that said more or less "So sorry, we've been on vacation for the last 4 days. I am home now and will get this shipped out monday morning."

Well I did get a notice from paypal on monday saying my item had shipped. Waited 2 or 3 days and hadnt recieved it so I went online to check tracking but it didnt tell me anything. Didnt indicate that it had been scanned in anywhere yet. But I still wasnt ready to panic since she had stated she'd been on vacation.

Then I received a notice from eBay that the seller was no longer a registered user. And a notice that the listing had been removed! Granted I know that there have been cases where ebay has suspended and removed legitimate sellers since I have read of it happening on here. So I still had a little hope so I decided to give her til this coming monday for the bag to arrive before I filed a paypal claim.

Well I had a notice in my mailbox last night that I had a package waiting. So I went into the post office first thing this morning, so excited to get my bag.

I signed for it and got out to the car then I realized that it was from CHINA! The label was an EMS label. I opened it up, it's a horrible pleather fake bag thats not even the same color let alone the bag that was pictured.

I came straight back to my office and went in to file a paypal dispute, I got a notice saying that my dispute has been received etc etc.
Then I get another email almost immediately telling me that the users account has been locked and their available balance is less than the amount involved in the dispute so a hold will be placed on their account in the amount.

Am I to take that as they have emptied out their paypal and my money isnt there?

Any ideas or thoughts?

even if they have emptied out your money...paypal or your cc company can still retrieve the cash...

did u call ur cc company and filed a chargeback?

Most likely they emptied right after you paid, yes. The hold will mean nothing since they won't be brainless enough to feed money back to it...

However, file the dispute, let PP tell you they can't get anything from them, and THEN file with your CC. Documentation that it's a fake may be well worth the investment, you may end up needing that for your bank cc. Did you make a copy of the listing before it was removeD?

I'm so sorry you're going through this. How awful!

Don't worry, just file a chargeback with your CC they should be able to get your $$ back
When you do file add all the details you can including auction stated the item was suppose to be in brooklyn but it came from china

I agree with SOLIDGOLD2. Don't wait to file with your credit card provider. I filed a PayPal dispute and contacted my cc company the same morning. My cc provider immediately credited the money back to my account. My seller was also removed from eBay, but she did eventually (3 weeks later) refund the money to my credit card. Right now, the important thing is to get your money back, and I think your cc company is the way to go. They may ask you to return the bag to the seller (mine did). I shipped via UPS, since it's supposedly a federal crime to ship a fake through the US postal system (interstate fraud). Good luck!

You can file a dispute under item not described. The reason why there is a hold on the sellers account is probably because there are multiple disputes open against the seller. Did you check the sellers info to see if they are covered by paypals buyer protection policy? The available balance is just what the seller had left in their account that they didn't transfer. That really doesn't matter because paypal can reverse the amount that you paid for your bag. Even if the seller wiped the account clean they are still responsible.

Just a quick extra note. Add the tracking information on the EMS package to the claim as it is the main proof that the bag came from China.

Or maybe file the claim as item not received??? If the tracking # she gave you don't work she have no proof of sending anything.
