Hello, I am new here (this is my second post). I donīt speak very well english.. so I may have some spelling mistakes here.. sorry!.

Ok, so like a week ago I bought a marc by marc jacobs utility bag on eBay... it looks like it is authentic... the problem is that it was described as NWOT, then it mentioned that "it was carried a few times" but it was "in perfect condition". Just to be sure, I sended an email asking if it had any smells , scratches or stains and the answer was "NO" ,"the only marks are from the natural leather.... but there is no scratches or stains" "it is as new".

So i decided to buy the bag and pay for express shipping to germany that was about 40 dlls, because I need it for a trip. I got the bag today...i t is FULL with scratches, it has a small hole on a pocket (you can see the lining), a few weird blue stains (small ones, but still...) and the leather pull for the zipper is broken. Also the interior is REALLY dirty, with stains, dirt AND A FEW HAIRS!!!

I sended detail pictures of this to the seller only to get a reponse that she apologizes for the dirty interior , that she admits she should have clean it before sending the bag, but that the rest came like this from Nordstrom, and that it is distressed leather thatīs why it is scratched. That I should go to the store and see by myself. and she didnīt offer any refunds.

Again I asked if we could get to an agreement or I should report this to eBay and she told me that I should have made reasearch before buying, because she lives in 5th avenue and sees this bags all the time and thatīs the way the are made...that if I wanted a clean leather look I shouldnīt have bought a distressed leather bag.

I already told her that the pull is broken and about the hole several times but she doesnīt admit it.. I have sended her the pictures and still wonīt admit it!

now (after several emails of telling her I will report this) she tells me that she will pay for the bag but not the shipping, which was like a 1/4 of the bag value. should I report this???instead of taking the money? it really makes me angry that I KNOW she should have mention the stains and the scratches but didnīt. An STILL is trying to convince me that thatīs how the bag came from Nordstrom.


I paste here several pictures of what I am talking about, so you have an idea of what I mean about SCRATCHES and stains...

what should I do? should I report this and not take the money? should I ask her for a better price for the bag (I would then sell it in eBay with a correct description) ? am I overreacting???

last ones...there is more scratches, but what I am so angry about is the dirt inside, the hole, and the broken leather zipper pull.

Oh dear, this is not looking good. You have asked the seller for a refund and she is not really helping. I would just tell her now that you will start a paypal claim as the bag is not significantly not as described. I love distressed leather, but this is distressed and very used.
You can open a dispute on Paypal and see how that goes. if she is still not helpful, you can escalate to a claim. Check the coverage your seller has from her auction. If you win you will probably have to pay to send it back to her. let us know how you get on...sorry this happened to you

Lots of people state NWOT but mean used few times. You should bear that in mind unless it states seller got it from an outlet where the tags have been cut, removed, or are damaged.

How much did you pay for this bag? Unfortunately the "used" condition is pretty subjective, everybody has a different standard of clean. To that seller it may still look clean obviously she has a lower standard of new.

If you're really upset you can file a claim through paypal, click on the transaction, file a dispute, then escalate to a claim. You must do this in order and in sequence, no waiting time required to escalate to claim. However it will a couple of weeks for the claim to process and paypal will give you the cue to return bag. You will bear the postage costs (insurance and tracking). If you paid less for the bag than what it will cost you to ship, I would keep the bag if I were you.

yes i agree but but new is new. It is the level of used that is sometimes questionable.
This bag can not be described as new

I somewhat believe her on this one. Often stores in US have a return policy and customers abuse it where they will buy a bag, use it, then return it for full refund or exchange. Many times I've come across filthy bags very obviously used, tags clipped back on or in a pocket, in major stores like Dillards, Macy's, and Nordstrom. I believe this is common practice in UK as well, or at least it was when I lived there few years ago. So the seller probably obtained this bag for cheap but can't qualify for a return because it was on clearance.

Therefore, it COULD be that the seller already obtained the bag in this used distressed condition from Nordstrom. Her version is "new" because she just bought it.
I don't know about you but I have bought dirty NWOT stuff on eBay, luckily for me Paypal ruled in my favor or I got a full refund from sellers. My point is I don't agree with sellers stating NWOT when item is visibly used. But for a fact, it's common practice on ebay.

I agree this this is not "NEW" as stated. If you want to keep the bag, see if she'll give you a partial refund. I dont' know what you paid but that could make a difference. If what you paid is significantly lower than what a NEW bag would be than maybe that is why (IE, not many bids?). I'd return it and pay for the shipping if she's offering. Sorry, not much help probably.

I would file a claim. It is definitely not "new". Nordstrom would never sell a bag with a brokern zipper pull and a hole in it! Nordstorm's return policy is very liberal, but they would never sell a bag that looked like that. Distressed is on thing, but that bag has been used and abused. Good Luck!

the thing is that I specifically asked if there were any other scratches or stains (even if she thought it was new when making the description) when I ask her this, she told me NO there are no marks, stains or scratches. I mean I didn't even asked about holes or if itīs broken.. because of her description !
This bag WAS 388 dlls plus tax originally, then it was for 138 dlls on bergdorf... also you can find it on eBay and BlueFly for 270 dlls...

I paid 200 on buy it now PLUS 39 dlls for sending, plus 25 dlls tax on arrival. and it doesnīt come with tags or a dust bag! (this I knew since the beginning) I was tempted to buy the other one with a dust bag from eBay...or BlueFly but since it was described as new I thought that it was really crazy from me to pay 70 dlls for a dustbag..so I bought this one :(

she has offered now to refund my money, but I would lose then 64 dlls! plus whatever it costs me to send it back! for a 200 dlls bag??? USED BAG?? and she will not lose anything, plus she probably sell it back on eBay as new!!! then I will buy it from BlueFly, pay AGAIN for shipping AND extra tax on arrival! GRRRRRRR itīs SO UNFAIR! plus she keeps telling me that the bag is so new and that nothing is broken!!!

heheh sorry for all the stress... thanks for the help!!! :)

The bag DOES NOT come with scratches. The leather will appears distressed - as in having little crack lines - but nothing torn or scuffed to it... this is totally a SNAD claim in Paypal - file the dispute and have it escalated. You will get the full purchase price back from her including the shipping you paid to get it. However, you will have to pay to ship the item back to her. I would do this the most economical way possible but be sure to insure it and get signature confirmation. When you file the dispute and the escalate it to a claim you will be able to upload the pictures of the back so Paypal can review them. Be very descriptive about the issues with the bag and be sure to also include all of the emails you have exchanged with her. It is AGAINST eBay policy to list a USED item (even used just once for an hour) as NWOT or NWT. PERIOD. I would report her to Ebay for that as well. Good Luck!!

Hello, thanks again to all for the help !

forenfinal: Really? including shipping? the only reason I havenīt report this already is because I thought I would lose the shipping costs, (that were in total with the german tax about 60 dlls), so I kept trying to solve this with the seller.. but if that is the case, I rather report it, lose the tax and get my money back AND give her a bad review that she totally deserves..
