Unhappy She still hasn't posted my bag out to me...

I really liked this bag when I was younger, but couldn't afford it. So since I've started earning money, I've been on the look out for it on and off. So when I saw it on eBay, I confirmed it here that it was authentic, made a bid and won! I'm very diligent with paying and paid pretty much straight away. The seller emails me to tell me that she's away from home and won't be able to post the bag straight away but will do so asap. I thought 'that's fine, things pop up and sometimes it out of your control'. Then 4 days later I get another message saying she's been unexpectantly delayed and that it may not be another week before she can post it out! Also if I want a refund, I am more than welcome...

At that point I'm not very impressed but think 'that's ok, at least she's kept me informed' and I really like and want the bag, so I tell her that's alright. Now it is 10 days since I've won the auction and 6 since the last email from her. I have a feeling she may not want to sell it and is delaying it, hoping I'll ask for a refund. I think I got it at a very good price, hence me being paranoid she doesn't want to sell it. PLUS she says she's a member of this forum, so really she should know how it feels when your waiting for a bag you want!!

I've also checked her feedback and a buyer has since left feedback for a top she won on the same day as me and has since gotten it!

I'm in a dilemma, should I ask for my money back or just wait? I've emailed her already to asked her if its been sent out but since its from the UK it may take another 1-2 weeks before I get it in Australia, that means it will be like a month, which is even longer than when I had a package go missing!

What should I do?

geez, idk. Whatever you do, do not let your time run out on paypal, wherein they can help you. I would keep trying to contact her and contact eBay and see what they could do.

how bad do you want the item? she has a good standing record but somtimes that really doesn't matter if a seller feels tehy didn't get as much as they hoped for they will simply find a way to not sell the item. i've even had a seller refund my payment because she felt she could get more for a bag. i don't know why they don't set a reserve price and be done with it. anyway if you really wnat the bag i think you should give her four more days max. and when she is delivering make sure she sends it express(something fast so you get it within paypal's return policy) andmake her pay for the difference in shipping out of her own pocket because she made you wait so long. i'm sure she will pay for the extra shipping charges because she does not want a neg feedback

why not open a dispute now? that gives you 20 days more to deal with her...if you feel its not gonna get anywhere then escalate it into a claim...maybe that will wake her up

First of all, it doesn't matter what she wanted to get for the bag. If she listed with no reserve, she got what she got. Second, when you win an auction on eBay, it is considered a legal, valid and binding contract to perform (buy or sell). Under eBay rules, she MUST sell the bag to you. You have waited long enough. I think you should file the dispute and go from there. You have, as was said below, 20 days to escalate to a claim. Do not let this deadline go by, as eBay considers this the claimant's responsibility. She will jump right to it, watch and see! She doesn't want a neg and she is obligated to sell and to ship the bag to you. Let us know what happens. Good luck

I think that was a fair price for the purse. The Monogram Mini line was discontinued a few years ago, and that was actually one of the first purses that were made.

Second, I agree with jjyounger. I would file a dispute, state that you never received the item, and she will JUMP to mail it, if she hasn't already.

Plus, remember now that you (the buyer) CAN NO LONGER receive NEGATIVE feedback and she should know that now, so she can not retaliate, if you DO LEAVE NEGATIVE...I have found that many sellers recently are taking more returns for misrepresentation, or even just buyers remorse, because they don't want to risk getting negative feedback...Let us know how you make out!

Absolutely! eBay is a buyer's Paradise at this time. Your seller has to be aware of that. Don't be afraid. She has far, far more to lose than you do. I am sure she will hurry to accomodate you once you file. Good luck!

the only problem with this is if the seller sends her the bag paypal will automatically close the dispute and if their is a problem with the item the buyer is out of luck because she can't open two disputes for the same item.

sellers know how to get around selling an item to you if its below what they intended to get. although the transaction is a contract eBay will tell you that the buyer can only open a "non performing seller". ebay will strike their account if they still refuse to send the item strike but ebay can't make them send the item. that's what happened to me and i never got the bag but the seller got a strike and was unable to get reimbursed for her ebay fees

I think that paypal has changed the only one dispute per transaction rule. I would check with them about this. I do agree that you should look into opening a dispute.

You do have 45 days to file with PayPal so if you still trust the seller kigwai then give the package another week to arrive.

I will give her another week for now. OR ask her to refund your money meanwhile and whenever she is ready to ship the bag request her to send you new pictures with her name and date (to make sure the bag and condition is the same as listed) and pay again. Make sure you pay with a credit card just in case... Good Luck!

Hi guys, I got a reply from her and she sounded very nice and genuine. She again has offered a full refund, apologised and says she may try to DHL it because she's in a country where the postal system is unreliable.

I'm quite happy with her response, then again I really want the bag! So I'm going to wait until another week and then decide. Thanks for the advice with paypal, I've not had any issues with sellers not sending items, so I really had to do more homework with paypal and the whole buyers protection. Its really good to know that there are so many tpf'ers so knowledgeable in this area. Thanks so much for your help, I'll keep you guys posted!

Well I had a NPB recently that paid after I filed and eventhough I paid for the shipping in Paypal they didn't automatically close it. After she received the bag and left me feedback I closed the dispute myself.
