redskater, thank you, I finally found someone at Paypal who told me that yes, I should get refunded as soon as the status of the package changes to delivered and I shouldn't have to wait for Paypal to collect the money from the seller. Problem is, USPS has not been updating info since they attempted delivery on October 5th. I did assume the seller received the necklace because she relisted it, but that can't be used as a proof that she actually received it. I know the PO was going to hold the package for 15 days and return it to me if no one was going to collect it. The package should have been sent back to me on October 17th if the seller didn't pick it up, but there is no record of that either. I called the customer service at USPS but they are completely clueless, so I'm waiting for the PO that supposedly was holding the package to open (they are in Sacramento) and try to call them directly and see if they can give me any further info. I'm quite upset no one at Ebay ever told me to open a claim, I must have called them 20 times and they just kept saying I had to wait and there was nothing else they could do for me at the moment. GRRRRRR.

This is because the people who are working in the dispute resolution service at Ebay have been scripts on what to say. They have no experience as sellers or buyers. They do not know how Pay Pal works, or the rules for either Pay Pal or Ebay.

And their job is to make you feel good about having someone to talk to or communicate with, NOT about costing them or Pay Pal money.

Do NOT think that either Ebay or Pay Pal will ever tell you how to best protect yourself or recover funds. They wont.

Uh, oh...I assumed that you had already opened a case with eBay or PP (after you contacted eBay), and that's why I couldn't understand why PP was waiting for the seller to refund your money. Now it all makes sense.

In order to get a refund from PP or eBay, you have to open a dispute, reach an agreement with the seller via the dispute process or escalate the dispute to a claim, wait for PP to make a decision, and if it rules in your favor, you get the refund from PP, not the seller.

In your case matters got complicated kuz of the seller's neglect to pick up the item or the USPS's neglect to update the delivery status. I didn't expect USPS CS to be able to help you much kuz they pretty much see what you see online, that's why I suggested asking for the phone number and business hours of the seller's local post office. So this one isn't open on Saturdays? Kuz if it is, it's not yet noon in Sacramento and you could still reach someone there.

karmenzsofia, I just did what Ebay customer service told me to do, when I called the first time I told them I wanted to open a dispute, and what they told me was that they were going to get in touch with the seller on my behalf and that I couldn't do anything else for 7 days. I assumed this was the way their system worked. I should have just opened a dispute online. Lesson learned.
I've been trying to contact the Sacramento PO directly since this morning, and the line is always busy. I contacted again USPS customer service and insisted on someone to help me, finally I spoke to a representative who opened a case for me, he said he was going to submit all the info to the sacramento PO to find out where the package is and that they'll let me know. He gave me a case number. He is convinced the package is already on its way back to me. I told him I wanted proof of that with a tracking number. If no one at USPS can tell me where the package is, I'm going to consider it lost and I will open a claim, thankfully I insured the package for its full value. If USPS won't help me getting my money back from Paypal, then they will be the ones who have to reimburs me.

I just want to thank everybody who helped me with this case. Paypal finally refunded my money today.
I managed to get in touch with the PO and they told me that the seller collected the box, but they “forgot” to scan it, so there was no way the tracking info could be manually updated.
Fortunately some nice agent from Paypal told me that because the seller relisted the item twice and most importantly, she initiated a refund (her echeck bounced TWICE by the way)it was clear she had the necklace back in her possession and refunded me while on the phone in 2 minutes.
This happened today at 11:30am, but just to prove that there are still way too many Paypal agents who don’t have a clue, I had already called this morning at 8:30 and another agent was still insisting that Paypal had to retrieve the money from the seller before they could refund me. When I told her that this was against their own policy she told me that she needed some time to review my case, that she was going to call me later, that maybe in 2 or 3 days I would have gotten my money back. What a load of BS.
Now I just have to leave feedback and then I’ll be ready to put this behind me.

I'm so glad you finally got the money back. It's maddening how careless about postal policy some postal workers are...

You finally got to talk to a PP agent who knows what he/she's doing vs. the dunce who insisted PP had to get the money from the seller first.
