Default Need to return a fake before I can get refund?
Can't believe this finally happened to me. I bought a bag on eBay and it turned out to be a total fake. The tricky thing is in the listing the item location is here in the U.S. however the package was shipped from China (from a person's name different from the seller's!). I already wrote to the seller for a full refund but unfortunately this seller rarely responds to email. My next step will be to file a SNAD claim. As I have never filed a claim before, I want to know if I need to return this fake to the seller before I can get my refund?

My major concern is if I'm asked to return the bag I don't want to ship outside of US due to the hassles and troubles, especially the reason I wanted to buy it is because the item/seller was in US according to the listing!

Please advise what to do, also what I need to provide when I file a SNAD claim...

I would open the SNAD and escalate immediately, paypal will instruct you as to what to do, they will also freeze the sellers paypal account so it can't be emptied out leaving you with no refund.
They(paypal) may want proof that the item is fake, maybe Caroldiva can help you out with that.
Just see what happens when you open the dispute first of all.

If they want you to send it back, make sure to get tracking and signature on delivery.
Others will chime in shortly with more advise !

But if the shipper and the seller are different (and in different places) in my case, where should I send?

You need to call ebay/PP and tell them exactly what is going on here. They will instruct you how to proceed. You may be on hold a while, but it will be worth knowing what you should do. Ebay is supposed to protect buyers in cases like this, but you need explicit instructions from them. Like WHO to send it back to, if you need to return the fake bag at all.

I reckon paypal will tell you to ship it to whatever address is on the sellers paypal account, i think i'd be inclined to give paypal a call.

Just called ebay, they asked me to contact the seller first, and then file a claim and follow the instruction, but they wouldn't tell me exactly who to send it back to and if I need to return it at this moment..

^Correct, until you file claim and escalate they will need to provide you the address where to return it to. They may also require you to provide documentation that it's a fake.

Don't ship it out until you file a claim and paypal makes a decision.
Don't wait for the seller to respond, just open a SNAD and escalate it ASAP.
If the listing said it was coming from the US, then you will probably be able to return the item back to the US address, but don't do so until either eBay or paypal makes a decision in writing (or online) and tells you to return it.

US address on ebay won't be used as ref. for a return if the address with PP for the seller is a non-us address.

I've already opened a SNAD. Do I need to escalate it also without the seller's response? My question is - does Paypal freeze the seller's account if I only open a dispute but not escalate it?

I can't wait I just escalated it because I suddenly realized it is probably a scam.
Right after I paid the seller, I received an email about an order I never place from ecrater.com! This email contains exactly the same item information on eBay and also my personal info on Paypal!

The more I think about it now the more I feel it's a scam. What else I need to do?

Can you please post the link to this ebay transaction? It might be helpful if we could see what is going on with the seller. And now ecrater!?!?!?!?!? Sounds pretty fishy

So, the seller has some of your information now and you're afraid they're using it to scam you through ecrater? Sounds like you need to change your Ebay information/login information NOW!
