Oh no, how frustrating. Seems like the seller isn't even listening to you or at least doesn't want to understand the problem.

Just tell her you will send the item back and expect a full refund. I would ignore her positive feedback comment right now. Send the item back and see what happens. You could still open a PayPal dispute if she doesn't refund after she received the item.

Sorry, but nowhere in your correspondence to her did you seem like you had buyer's remorse or you were disappointed in the purchase itself. You CLEARLY stated to this seller several times that it was the wrong size, and it didn't fit you. Enough said.

Why is this seller going back and forth with you over a lousy $20 S&H? In retrospect, you have the opportunity of giving this biotch a negative, whereas she doesn't. You clearly have the upperhand in this case, and I would definitely escalate it to a claim and let PP decide. I'm certain they will side in your favor on this one.

Although with PP running rampant with BS claims these days...you just never know!

This seller is clearly smoking something...

She made an error and will just not own up to it. Oh, but this, dear PFers is the best part of her nonsense message:

On reciept of the dress and reciept of POSITIVE feedback, I will happily give you A FULL REFUND (including the postage you paid).

Please post the item today I will expect to recieve it 7 days and this matter will be cleared. I can not be fairer that that.

AND she's going to now acquiesce to giving me my postage after refusing before, given I comply? I would rather eat glass! Dispute escalated to a claim. You have messed with the WRONG lady, missy.

I know this is peanuts compared to some of the fraud people on this forum/thread have been subjected to, but there are obviously more idiots and thieves on eBay than there are decent, honest people anymore.

I hope everyone who is dealing with eBay drama gets the resolution they deserve.
Save ALL correspondence with this jerk. Because I would not only forward this e-mail to PP in your claim dispute, but forward it to eBay as well, as she is clearly threatening your refund with positive feedback.

This just happened to me the seller send me the wrong size of jeans. Therefore, I opened a claim with paypal and the sided with me and got my money back including shippng charges.

I once bought a really cute bra that was a size different than what was listed. I contacted the seller several times, never got a reply, and then filed a PayPal dispute and got all my money back + what I payed for shipping. I wasn't even asked to return the bra to the seller, probably due to his/her silence. I sort of felt bad.

Anyway, this would definitely file under a "misrepresentation of product" case. Good luck!

I just wanted to mention something that I discovered last night that I thought was interesting. I was looking for a price tag belonging to a bag I am planning on taking to my local consignment shop, and I try to keep all my tags for bags (or anything else I might need the original tag for) together in a drawer. Now, I stated before that I have a similar outfit to this one, also by the same designer for her same H&M collection, in my correct size- the size the auction claimed to be for. I found the original H&M price/hangtag in the drawer. I stated before both here and to the seller that I do not know my UK size but that this garment is sized on it's inner label in Euro sizes only, so I know the correct size I need. The seller just simply REFUSES to admit she made an error and claims that she stated the UK size so that it doesn't matter what she claimed the Euro size was, that I intentionally purchased the wrong size. I'm not quite sure what I would have to gain from intentionally purchasing the wrong size, but let's just say, for argument's sake, that the seller is off the hook for stating the wrong label size as she has stated her estimation of the UK size and that is good enough (not true, considering that this garment isn't sized in UK sizes, but let's pretend). The seller over and over claimed that she said in the auction that this garment would best fit a UK size 6-8, so I am the one in error, not her.

The original H&M tag for the size 34 garment has the "Euro" sticker covered with a UK sticker. Under the UK sticker (since both are white with black type) you can see through it and it says the Euro size (34) and the original price in Euro. The top sticker (for the UK market) states the price in GBP as well as Euro, but also states the UK size.........................

8!!!!!!!

So, even by H&M's estimation, a 34 fits a size 8. So how in the world could a 36 fit (by the seller's estimation) a 6-8 if the smaller 34 translates to an 8?

I know it really doesn't matter, and that the seller was in the wrong all along just for insisting she was not in error, but I just wanted to share this further development. I doubt they'll need it, but maybe paypal will find it useful.

Woe, she's got all kinds of defects, this one! Misrepresenting an item, feedback extortion...personally I am really glad that you are pursuing this as it's these types that keep on ruining eBay for everyone. Just keep pulling them out one weed at a time, I guess !
Be sure to send her feedback extortion email to both eBay and PP as soon as you can. More so Ebay as they may suspend her account over it and in IMO this twit shouldn't be allowed to sell a speck of dust with her attitude being what it is.
As well, if she stated it's a 36 and sent a 34, it's a clear-cut case and you can rest easy, there's no way she can win. What a moron!

Geez, what a rude seller!! Definitely file a paypal claim!! Good luck with this, I hope you get all your $$ back AND can keep the item (then you can go get it altered with the money you didn't spend. :P )

ITA! She should be reported for feedback extortion. You are going to get your money and shipping refunded regardless of her position. VERY galling when sellers demand positive fb. I am a seller and I would never consider such a thing. If it was my mistake, I would refund. It's quite simple. The jumpsuit is a 36, she stated in the listing it is a 34. She sold you the wrong size, not to mention a used item. Period. I'm glad you escalated, Gina. This seller is a total nitwit. BTW, you were extremely courteous in your emails and nowhere did I get the impression that this was in any way buyer's remorse. Besides, this is not about the money, it's the principle. You're 100% in the right here, IMO.

Yes, when you win a dispute you are refunded the entire payment; however, you are responsible for paying return postage. I always believed this was unfair, as some sellers really are irresponsible in their listings, but it is how Paypal disputes are resolved. In the end, it will cost you return postage to get the amount you paid the seller back. This is also a clear situation for giving negative feedback. If, as a seller, I treated you the way this seller has treated you, I would expect to receive negative feedback.

OMG! This is ridiculous! File a charge back for SNAD immediately. What a manipulative jerk!
I too am a very understanding buyer. I waited for 2.5 weeks for an item recently because the seller was away on business (which she did not state in the auction). I only inquired about the tracking number after I didn't hear from her after 1.5 weeks! I still left A+ positive feedback on all aspects of the purchase including shipping (which was over $50).
What a looney!
