Unhappy Just opened my first dispute...advice? :(

I've never filed a paypal dispute before...some of you may remember that I bought a handbag from a seller who didn't respond for nearly a week. It turned out that her daughter was in the hospital. She then sent it out and when I received it, it smelled like smoke! So I contacted her again and she said she'd take a return. So I sent it back via Priority Mail with Delivery Confirmation, and she confirmed that she received it on Saturday. Today is Wednesday...and no refund. She said on Sunday that she'd refund me on Monday via Paypal or money order (I have no idea why she'd send a money order since I paid through Paypal), but I haven't heard from her since despite several emails. I'm afraid that she didn't send out a money order, since she said she'd most likely refund me via Paypal. Was I right to open a dispute? Do I have any chance of winning it? Thanks so much for your help guys, and sorry if that was confusing!

You have every right to file a claim with PayPal kimalee, you are out of your money and nothing to show for it. PayPal should refund you because you have proof that the item was delivered and the seller herself confirmed that she received the item back. If PayPal rule against you (highly unlikely), you will be able to get your money back with your credit card issuer. Good luck!

I would wait till this Friday to file the PayPal dispute. She probably will respond but being slow. You could file a SNAD and escalate it to a claim the next day. In your claim, you could indicated the seller agreed for the return, and enter the delivery confirmation tracking info so PayPal knows you already returned it.

kimalee, since she has confirmed that she received the bag, you need to save her email confirming receipt. In the future, if you ever ship an item back to a seller, you probably need to get Signature Confirmation rather than just Delivery Confirmation. I remember this whole nightmare! You had every right to open your dispute and I am sure this will get the seller's attention quickly. Let us know what happens. Best of luck with this, sweetie. Enough is enough!

do I need to escalate it to a claim? If so, how/when do I do that?

and when I was on the phone with PP, they said the seller would need to prove that the item had no smoke smell in order to win - how on earth would she do that?

I seriously doubt if that is possible. It's like trying to prove a negative! They are so unbelievable. In answer to your first question above, if you want to escalate to a PayPal claim, you must do so within 20 days of the day you file the dispute. Per PayPal, it is up to you to keep track of this date. You will sign into PayPal and go into the Resolution Center or Dispute Center or whatever they are calling it now. From there, you can escalate the dispute to a claim. I know you are so ready for this to be behind you. Good luck, doll.

You should be OK. Keep the emails because you're probably going to need them. When I opened my first dispute they asked me for all correspondences between the two of us and of course I sent them everything. It was decided in my favor. I paid like $275.00 for the item but only got $200.00 back. I think it had something to do with the seller not being verified or something like that. Just two weeks ago I won a Soufflot for $350.00 from some girl in Malaysia (who was also not verified) and she never sent the bag. I filed a claim and she never responded to paypal and I got all my money back within 10 days.

Thats exactly what I did...thank God they just get moved to the message folder!! Since she agreed to take the bag back and issue a refund I don't see how you can lose. Be aggressive with paypal though..the aggressor seems to win..kwim?

Well, some company practice this kind of "business", but in the end everything will be ok and PayPal will help you to take back your money.
I just want to tell you story of a friend of mine.She bought an item online, but she has never received it.She contacted several times that company via email but with no response.Finally she reached them by phone and ...Company emailed her that her order has been dispatched but possible it has been either lost or stolen and they refund her money in full in same day when receive her email of not receiving.The reason is that all company's emails goes to my friend's spam folder.Amazing yes?So many problems and nerves in vain. Thanks God her story has a happy end.
Hope your story also will have a happy end.

What a joke! She contacted me today saying that she sent out a postal money order as a refund, even though she said she'd send it on Monday. She also informed me that she took the bag to the store to have everyone there smell it, and none of them (or her) could smell smoke. How rude! I'm so insulted by that! Anyway, I'm not closing the dispute until I have the money in my hand...at this point, I don't even believe that she sent it out.

Uggh. I am so fed up with eBay.
