Default I'm Going to Hurt Somebody ... Stop Me if you Can

Okay, not really... but I've had 3, count 'em one two three bad @bay transactions in a row as a BUYER.

I've only had 1 other dispute in 6 years. Two items were cheapies and one was over $200.00

I have "resolved" the largest purchase after 2 weeks of he11.

I do have questions on these two:

Item #1:
Arrived DeadOnArrival, does not work. Seller ignores my emails that the item isn't working so I file a dispute. Immediately (within minutes) he denies my refund request and leaves a nasty message telling me to send it back, in the original packaging (so he can resell the nonworking item, no doubt) and he'll refund. The seller, who has 69 negs in the past few months will not mind another.

So, I left him a message saying I'll send back the DOA item as soon as he PP's me the money to do so. (shipping) I'm certain this will not happen.

question: Does PP require the buyer to return SNAD items at buyer's expense? Will Paypal require me to send it back if seller doesn't pay for it? By the time I pay for shipping/confirmation this item will cost more to return than if I just throw it away. He's one of those sellers who overcharge shipping to circumvent fees.

**yeah, I should have known better on this one but I had a free ship code so I took a chance, rolled the dice and... L O S T


Item #2:
Item described as brand new, in package. Item arrived without packaging and appearing used. I've filed a dispute because she dances around emails and cannot give me a single straight answer. She said she would refund but again, wants the used item back. Same story, this is a little more pricey but do I get stuck with return shipping? She straight up lied about the sealed packaging. I so would not have bid
questions:
Who pays for return shipping?
What kind of feedback would you leave?

The way I understand it, paypal requires a buyer to return the item before a refund is given and the buyer has to pay for the return shipping. But when the buyer is refunded, their original shipping is refunded with the price of the item.
I don't think it's fair if the item is SNAD but I'm fairly sure that is how paypal does it.

yes I think you would be out of the shipping to send back to the seller. I hope this rule changes soon.

anyone who has had 69 negs in a few months is not going to be a helpful seller, but yes, i think you'd have to pay to ship it back

Just me, but I would never purchase from a seller who 69 negatives or 30 negatives or 20 negatives or 10 negatives.

With regard to return shipping, yes, you have to pay to return the item.

Good luck on getting these transactions closed so that you can move on to happier buying/trading experiences.

I know it sounds terrible, but the "Powerseller" has over 50,000 transactions with about 100 positives each day. I was hoping to be one of those. I deserve what I got on this one but the item itself was under $10 so I was willing to take a chance.

I did not know that the buyer is required to return an item at their cost when a seller knowingly or otherwise sells defective or SNAD items. I'll leave my negative and it will get buried in a day but I'll feel a tad better.

Does anyone know if you have 1 claim against your PP account will it freeze all your funds or only for the amount of that claim?

It sucks that you won't get your shipping back, but you'll be okay for the rest because PayPal takes the money out automatically for refunds after a certain amount of time, at least that's how I remember it. It would be good if you make sure you send the items back with signature confirmation, insurance, whatever will keep you safe. Also, try to avoid the sellers with so much negatuve feedback next time. It's not worth taking the risk of being one of the people they decide to not lie to, even if the odds are in your favor.

Well, you have had enough awful experiences to last you quite some time! Yes, you are responsible for the cost of shipping the item back (so unfair) and I would definitely leave a neg.

PayPal freezes ONLY the funds in question, not your entire account.

I had the same problem as you. The item (a bag) was listed as new no flaws whatsoever. What I got was the bag with the top pictorial coat started peeling all 4 corners, incl. the hinge area. I contacted her right away asking for refund. She danced around a few times. I had to copy her description on the item for her to admit it! Finally agreed to return my money only for the cost of the item which left me a burden of $28 shipping cost for both ways. It's not the end of it. She initially didn't want to paypal me, which was my method of payment, for the refund but sent a personal check instead. When I stated it's only fair for her to refund me in the same method as I paid her, she mentioned a lot of her personal reasons which honestly should not be my concerns at all. At that time I agreed just to get my lump sum back but asked her to certify mail. Finally, she refunded my money via paypal and asked me not to do business with her again like I'd want to. Wasn't I supposed to be an injured party here to be treated like that?
My answer is it's up to you on how far you want to go for to get your full refund back. For me, I only wanted to have my bag coming in the same condition as I expected when I bid. I hate to be bothered and harassed by the dispute over refund issue if there is anyway to compromise. But here was what I got from the seller with 98% positive feedback.
I've stopped shopping on eBay for quite a few months now.
