Default I just bought received a FAKE bag and I am so mad/hurt/upset/pissed !

I just bought a bag from a seller on eBay....and the bag arrived like 5 minutes ago.....a TOTAL FAKE. I said to myself right after buying it and paying for it that I should have asked for more pics of the zipper, etc....but hoped it would be ok.....


The bag came today and before even taking it out of the so called "MJ dustbag"... I knew it was a fake....how did I know??? Well the bag was way tooo light... in fact I had this exact style of bag before....it the MJ stam hobo... I had it in cashew and thought it was my lucky day when I saw one on eBay in black..,..So I contacted the seller and paid for it... the thing is she ended the auction and sent me an invoice...i paid and I will be contacting paypal in a few minutes......I am so pissed right now.

So after getting it today, I wrote the seller and she told me, because she ended the auction for me, because she sent me a few pics and because she did not guarantee authenticity....she shouldn't have to give me my money back....WTF??

Are you kidding??/ I'm a seller on eBay myself.....if I EVER sold a fake, which I would never do.....if someone says it's a fake I better damn well give them their money back......

Here's my initial email to the seller:

Hi Amy,

I got the bag today and the first thing I noticed is that it was a fake. I didn't even need to take it out of the dustcover....I know alot about Marc Jacobs and this bag was way tooo light....in fact I had this exact bag in a color called cashew. I want my money back immediately or I will contact paypal, eBay and file a report. This bag came by UPS less than 5 minutes ago and I am so disapointed right now. The bag couldn't even be mistaken for real by a knowledgeable Marc Jacobs buyer, in fact it is not even leather. The Lampo zippers on it are not even real lampo, which would even be the wrong zipper for this bag. I would like a full refund including shipping and $10 extra to ship this bag right back to you.

I am so sick to my stomach of dishonest sellers on eBay, I sell lots of MarcJacobs items on ebay and I know authentic Marc Jacobs bags. Please respond within 3 days with a full refund or I will contact ebay, contact paypal, file a police report (because you sold a fake) and also put a stop on payment from my bank.

I received your email, and I do not know what to say. I sent you every bit of information that you asked for regarding this bag. I purchased this bag on eBay myself and paid over $500 for it. I have absolutely no reason to doubt its authenticity,however I NEVER guaranteed it's authenticity to ANYONE. Buying an item on ebay, I could not provide such a guarantee, and therefore, that is why the bag was priced low. I took close up photos and gave you the best information that I had. I have re-read each of your emails and your questions all pertained to the wear/condition of the bag. I still have no reason to doubt it's authenticity, and because I gave you all of the photos (close ups, etc...) and info that you requested, ended the auction early for you, despite other people who were interested in the bag as well, and offered the bag at a very reasonable price,I think it is wrong for you to try to return this bag. If you would like to contact ebay, I understand, but you need to understand my position as well. I have no idea which brand of zippers are supposed to go on which purse, I only know that I purchased an expensive bag on ebay, and sold it for considerably less than I paid for it. I hope you will consider my position as well.





Come on a be real......you can't do this to someone....that's just wrong....She claims to be a lawyer....she should know better then....The bag is so obviously a fake...when you look at it it's pathetic... I'm mad at myself for not asking for a picture of the zipper.... I saw a picture of the name plate and thought that it was authentic....now i know better.....

That is sooooo upsetting. You need to let her know she is a fraud and you will in fact follow through with the actions you told her. I am sorry this happened to you. How much did you pay? Was it through eBay and paypal?

Sorry this happened! If I were a seller and it turned out the bag was fake, I would definitely take it back and I would be pretty embarrassed too! Hope you get your money back! I'm sure she's also mad that she paid that much money for a fake.

i'm sad she paid for it too $500 is not cheap...but to try and sell it to someone and when you contact you, you basically say 'it's not my problem' is unacceptable... i contacted paypal.... i foled a dispute and i need to contact CarolDiva....anyone know how to contact her?? search is down yet again!

As far as I know, if she listed the bag as a "Marc Jacobs" and not "Marc Jacobs like" then you can file a dispute because she misrepresented the bag. Listing it as Marc Jacobs when it is not would definitely be misrepresenting.

AcK! How upsetting! I bet she probably DIDN'T know it was fake going into it, but doesn't want to take the fallout from the knowledge that it is.

Did it say "authentic" ANYWHERE in the auction? If it did, then she did "guarantee" authenticity. You are guaranteeing that your auction is correct and represented correctly when you post an auction or else the buyer has the right for refund or to get reported. It's that simple. If nowhere did she say authentic, I don't know if she could argue it even if selling fakes are prohibited.

her website is caroldiva.com.... good luck with the claim. the seller can't say she can't allow you to return it - sellings fakes are illegal! Tell her you'll contact the police in her area.

thanks for your help ladies....I already told her...I'm not the one...she thinks she'll get away with it...she's told me... that she shuold have let the auction go through....i told her she probably should have as well and some poor sucker would have bought the bag and she wouldn't have had a buyer that knew what they were dong...she would have gotten away with fraud, but she got me instead...it was not her lucky day...

Yep! I agree. Fakes are illegal and not allowed on eBay so she should have been sure of that before selling you a fake.

I would just start the claim process since I don't think you'll get anywhere with her. Good luck and please let us know what happens.

aggie, i'm so sorry!

did you purchase the bag through eBay or simply paid for it using paypal. you mentioned that she ended the auction early for you. can you still file a snad through ebay if you didn't technically win an auction? i know paypal will still offer buyer protection, but isn't it up to $200 only?

the seller does not sound like a lawyer. it's so easy to claim that you're a doctor or a physicist or the prime minister of kenya over the internet. if she were really a lawyer, she would know that just because she herself didn't guarantee the authenticity of the bag, it does not absolve her of any liability for selling a replica through eBay/paypal. lawyers (and everyone else for that matter) are supposed to have a firm grasp of the rules and regulations before entering any type of contract. selling and buying on ebay involves contracts. the obligation to pay for an auction when you win, the obligation to sell the item to the highest bidder and to represent an item truthfully, etc. just because she has the money in her bank account does not mean she can wash her hands of the transaction entirely, so her assertions are ridiculous and rather childish. certainly not lawyer-material unless she's a low-rent lawyer.

good luck with the claim and, above all, be persistent! save all of her correspondence as evidence and begin filing that police report. take pictures of the bag and if you can, save the auction item description, seller's pictures, or a screenshot of the listing. an authenticity letter from caroldiva would certainly help too. the more you do, the more you can intimidate her, the better.

lol kim... i know she's not a lawyer.. i plan on going to law school and that drivel of a defense does not hold up... i got a little snappy with her in my email and she says i'm being abusive...i wanted to snatch her hair... and show her real abuse..lol
