Unhappy Here we go again...

Last week I posted about a "new" phone I bought that was used - I confirmed with the Sprint store that it had 3 previous owners, and the seller sent it with the wrong brand of charger. Anyway, he told me I could return it, so I sent it out last Saturday with $200 insurance and direct signature, and it seems like all is fine and well. Fastforward to this Saturday - I check the online tracking, and it says 'left at front door; no signature service requested'. WHAT!?!?!?! So I called Fedex, and it turns out that the guy who helped me at FedEx didn't realize that I'd checked the direct signature box (it's marked on my receipt). I also emailed the seller on Saturday, and he was out of town (supposedly returned yesterday night). I haven't heard a word from him since then, even though he said he'd contact me yesterday. I'm scared he's going to keep the phone and the money - can I still open a dispute? And if I do, can I still win it even though I don't have a signature confirmation that he received the return? I'm so confused, help!

I don't know if I should open the dispute now because I'm afraid it will offend the guy and then he won't refund my money out of spite...what do you guys think???

I had the same thing happen with Fedex. Do you have a copy of the form you filled out for shipment? If you do and it has the box "direct signature required" checked off, you should be fine.

You will need to open a claim with Fedex, they will pull the original paperwork you submitted (that is a multiple copy form) and you will be covered for the insured amount (if necessary)

hey, thanks so much for responding! yea, the copy I have has the 'direct signature required' box checked off...but I still haven't heard from the seller. That's why I'm not sure if I should file a PP dispute or a Fedex one!

Well, since you don't know if the seller is going to deny receipt, I wouldn't file a Fedex claim yet. If it was me, I would send the seller a note asking for the status of your refund. Next steps will probably be determined by the sellers response.

Hopefully he'll process your refund and life will be good again . If he denies receipt of the phone, I would immediately file with Fedex.

wow.. that stinks. i would just wait it out... maybe send the guy a friendly email and say.. how was your 4th..? make small talk.... i know it sounds callus but it works sometimes.

ITA! Excellent advice. kimalee, I have had horrible problems with Fed Ex. I would never use them again. And you have had more than your share of eBay problems. Good luck, sweetie.
