Default HELP! I received a FAKE PRADA! What do I do Now?

Hey Guys,

This really sucks! I have been buying off eBay for not too long and I had no problems until now...

I received a Prada Tessuto Handbag that the ladies at the "Authenticate this Prada" thread said that the bag was fake! So then as one of the fellow posters added that if I were to post the listing then they could report it and then my problem would be solved. Anyways I did this and it must have worked because I received this email from eBay today:

So my question is what do I do now? I have opened a claim with paypal a few days ago right after I received comfirmation that the bag was fake. I thought about escalating the claim but then I decided to give the seller a few days to respond. Well she hasn't tried to contact me at all and now that eBay has removed the listing...am I in the clear to escalate the claim? Do I now have some sort of evidence that the bag is fake? I just want my money back...

Please help me. What should I do? Is it safe to Escalate the claim now? I just dont want paypal to side with the seller and then have the seller end up with their fake bag and my money!

Paypal will ask for a letter stating it is fake. You can get such letter from my poupette.com or caroldiva.com, both charge and I do not know if they do Prada, you should contact them first since Paypal will require the letter within 10 days once you escalate. They cahrge fee for this letter, BTW. If you paid by credit card, you could also do a chargeback but you will need to either prove it is a fake (again letter) or that you sent it back, you will need signature confirmation that it was received by the seller.

I also hear from other threads that apparently PayPal is now asking the buyer to send the fake bag back to PayPal???

I thought that was really weird, but I guess that's part of their new thing now? Anyway, so expect them to say that, I imagine once you get everything authenticated (or in this case, unauthenticated).

I recently received 2 fake LVs from the same seller. I immediately contacted eBay by phone and they told me to escalate to a claim immediately and return the items to the seller with tracking no. & confirmation. I got my refund back within a week of the claim.

This case is different. If you have paid , not received bag and the listing is removed, Paypal should refund you. Can anybody clarify?

I believe if the listing is removed, buyer is off the hook having to proof that it's a counterfeit!

See post #5.

See it doesn't hurt reporting counterfeits even if the auction has ended!

Thanks! The only reason I didn't want to use mypoupette.com was because of the high fees. (the item was not that expensive, under $200), I have actually never used this website before. Would I need to pay for the authentication $20 (for non-LV items) and $15 for the letter?

*UPDATE*: I contacted paypal and the guy who helped me was very nice. He said that since the seller had up to $200 for buyer protection, i'm covered for the cost of the bag since it was under $200. He helped me to escalate it to a claim immediately and he said something about the sellers funds being put on hold while there was an investigation. I just hope that they put it on hold when I filed the dispute and not when I filled the claim, since this would have given the buyer some time to empty her account. Anyways he says that the buyer has 11 days to respond and if she does then eBay will look at both sides of the case...i'm not sure whether i'm relieved or not about the situation

Ugh...problem is that I have paid and received the bag...realized that it was fake then the item was removed from eBay! So I guess I have to wait for the seller's response now...

You should have worked on getting your money back before reporting, but if it all goes well you will be receiving a refund pretty soon [since his funds are frozen and all, the seller doesn't really have a choice].

I also don't think they will ask you for any proof of authenticity since they pulled the listing(s) themselves. Still, be prepared to send the bag back to Paypal...

Thanks! i really hope that I do get the money back...the seller seemed so honest! I guess I really have to be more careful next time...no more prada for me!

I'm glad that they won't be asking me to prove the authenticity...that would cost me a lot of extra money. Lol...I wonder what paypal would do if I sent them the bag pre-destroyed...how else would I know that they really destroy it. I looked at this bag really closely and it really almost could have passed for real, except for a few minor details...
