Default HELP!! Can buyer still file a chargeback?

I have a bit of a problem on my hands. I sold a bag back in december on the 21st. Well everything went fine, positive feedback all around etc. well now yesterday on June 5th I get an email from her wanting her money back. Her first email just stated that she would like a refund, no reason given. So I wrote back and said "I'm sorry but you've been using this bag for 6 months now, why are you asking for a refund now? If there was a problem with the bag I think it should have been addressed long before now. So I'm sorry but I'm not willing to issue a refund especially since I don't know why you are asking."

In the meantime I go and check her out on eBay, toolhaus and goofbay. Turns out she has listed this bag for sale 3 times already. Which is fine except that she has been selling at fixed price with an asking price that is $211 more than she paid me AND $86 more than the bag costs brand new! And this one is used, so of course it hasnt sold.

She emailed back and said she wanted a refund because shes recently "discovered" its fake. I replied and told her that a. It's not fake and if she would like to see the receipt I still have it, and furthermore she could post it over here for authentication. and b.) I was sorry noone had bought it for the overinflated price she was trying to get for it but that doesnt mean I should refund her.

Her response : "No problem I'll just file a chargeback, sorry but I need money right now more than purses."

Can she do this its been 6 months? I have all my proof (store receipt) and her emails more or less saying she is going to scam me. But I know how paypal is, if its a chargeback its usually a done deal. Any advice?

YES she can. I am going through that right now 8 months later.

The good part is that you have emails to prove that she is only wanting her money back because she needs the money.

I believe you will win this case with no problems, however, they are going to put a hold on your account for at least 30 days if not longer while they sort it out.

UGGHHH this is so unfair, it makes me want to close my paypal account! I have just been hit with a rash of scammers and unscrupulous buyers lately.

Question, is there anyway to tell what type of payment (what kind of cc) was used when someone pays you? My chase credit card will only allow chargebacks for 90 days.

Yes, keep all her e-mails, store receipt and make a copy of all her auctions to sell the same bag so you can send it all to PayPal if there is a chargeback. I am hoping that her credit card issuer will not let her do a chargeback because too much time had passed. Good luck!

If you can still find it take a screen shoot of the 3 auctions where she tried to tell the bags so when you have to give your side of the story you have that as proof. Don't forget to include the email where she states she needs money more than purses. Im sure she will not get it. The nerve of these buyers. Whats wrong with them

Make sure you can document that she's tried to sell it too. So obviously it's not a question of whether she has it in her hands or not.

yep do take screenshots of the auctions and send them to paypal! also screenshot and forward the emails you have received where she has admitted to only needing the money and not the purse "right now"

its people like this who make life hard for honest sellers! x

I know there has been revolving reports that PP won't take pictures, but you could atleast provide them a public site where they can view them if they so choose.

I cant believe some people. How dare she be so rude. I sometimes buy a bag and think I have been to extravagant but I usually sell on for the same price or a bit less. But 6 months later?? Crazy. maybe you could alert Paypal to this but she may go directly through her CC anyway. Keep those emails and good luck.

Sorry that you are dealing with such an unreasonable person! She sounds like a nightmare. Once she files a claim with PayPal, you may consider calling PayPal and speaking with someone directly. I have only had one instance where someone filed a claim against me and it was supposed to take 30 days before there was a decision. I called and spoke with a representative to make sure I was providing all of the necessary information and within 15 minutes of my call the case was closed and the $ was back in my account. Good luck!
