Hi I think Ebay's seller limit and blocking policy stinks too! A class action suit for damages needs to be organized and filed against ebay. I have excellent and a high number of long term feedback and I have selling limits and blocks on my account also. In addition to this I have done research on the blocking policy and have found major discrepancies regarding who is being allowed to sell different high dollar and popularitems on Ebay. Also, Ebay is keeping the actual policy and its implementation TOP SECRET! Ebay’s Trust and Safety Department and Customer Service will not provide a member with a copy of the policy document, what type of limits and blocks are being put on their account, and why their account has been targeted. I have emailed Ebay's President Meg Whitman about this policy and even she would not provide me with a copy of the policy or any details about how and why my account has a selling limit and a selling block on it. In addition to this the following response sent by customer service to me is accusatory, slanderous, libelous, and is a personal attack on my character please read below:
In order to maintain a safe trading environment, selling limits are occasionally placed on accounts. A restriction was placed on your account to limit you from selling or revising certain items. The restriction will remain active at this time. Please keep in mind that you are not permitted to sell items on eBay bearing the name or logo of a company if the product has not been made or authorized by that company. In addition, the sale of counterfeit items, unauthorized replicas and unauthorized copies is prohibited by law, and therefore cannot be listed on eBay. It is the seller's responsibility to ensure that the items you are listing are authorized for sale. This policy also helps protect buyers from purchasing counterfeit or fraudulent items and helps protect the intellectual property rights of third parties. This policy is not being used to protect buyers! It is being used to hurt Ebay members that are not Power Sellers and are being discriminated by Ebay! Ebay beware Ebay Stores are closing, Ebay's stock value may be affected, and a class action suit is on the way! We just need to find an attorney that has the guts to fight Ebay in court and get all of the Ebay members that are being targeted organized to file a class action suit. |

I just mailed a letter about this to eBay's CEO today. I've had selling limits placed after almost ten years on eBay and all positives with no negatives. My letter included printouts of new members selling clearly counterfeited items as well, to make my point. I also got the canned reply you listed above, and it took THREE WEEKS for them to send it to me after I inquired about this sudden "limit" on my account.

I have sent numerous emails trying to find out why all of a sudden there has been a limit placed on my account (been member since 2000), and what that limit is, and so on. I get no satisfaction of an answer, despite fact that I have sent them in my emails, links to auctions that are clearly selling fakes. I gave up, I finished my last bit of selling on eBay and am now taking all my designer items to consignment (just took CHANEL bag and wallet). While I don't make nearly as much profit as I would on eBay, there are no headaches...I drop off bags, they sell, I pick up check. DONE.

Ebay’s Top Secret Blocking Policy has nothing to do with the Anti-Money Laundering Act. As this policy is affecting John & Jane Doe who are just selling on Ebay to put food on the table, buy something extra for themselves or their children, or use selling on Ebay as a source of money to put their kids through college. The Top Secret Blocking Policy is not affecting Ebay’s Power Sellers who are making tremendous amounts of money on Ebay and for the Ebay Corporation. I am not suggesting or accusing any or all Power Sellers of doing this. But Money Laundering Schemes are used to hide or clean large sums of money not the small amount the average Jane or John Doe seller is making. The Top Secret Blocking Policy also is not being used to control fraud on Ebay as it is the high money earner who has the financial capacity to create or buy large quantities of counterfeit items to sell on Ebay. The Top Secret Blocking Policy is affecting Jane and John Doe mentioned above. What the Top Secret Blocking Policy is doing is violating free trade and creating monopolies on Ebay for Power Sellers. Let’s face it, Ebay is a large high profit making Corporation they are not concerned about using the Top Secret Blocking Policy to prevent fraud on Ebay since the policy is not targeting those capable of it. What they are doing is creating a trading center of e-commerce that protects and increases the amount of money that Power Sellers are making both for themselves and Ebay. It is my opinion that a class action suit against Ebay is in the works. I would also suggest to anyone who is concerned or has been negatively impacted by the Top Secret Blocking Policy that they do the following:

Any letter that states you have selling limits and blocks put on your account as part of the implementation of an Ebay Policy established to control fraud on ebay (form letter or not) directly or indirectly implies that your account has been or is being reviewed for potential fraudulent activity. By the letter of the law this is libelous in nature and would most likely be taken that way if a class action suit was filed against Ebay. I am aware that some Power Sellers are being targeted also, as I have some friends that are closing their Ebay stores because of the Top Secret Blocking Policy and I deeply apologize if I have said anything regarding Power Sellers that has hurt your feelings. However, this policy is primarily targeting new sellers and sellers that are not power sellers. It is not time nor in our best interest to segregate power sellers and non-power sellers in this fight against Ebay’s Top Secret Blocking Policy but time to unite and fight for our right to free trade on the e-commerce market place. I was most impressed by some of the suggestions other members have made concerning taking action against this Top Secret Blocking Policy. If you have time to read them you may want follow their advice for action? Just a suggestion, now if we could get national coverage of what is going on within the Ebay Corporation regarding this policy and our discussion group that would be great!
