Default Can I get my money back?

I recently got scammed, I paid and never got my items so I opened a claim for non-receipt, in which paypal ruled in my favor. They weren't able to refund me so I called my bank. Now paypal is asking for confirmations on my account, which I did. The tricky part is, the bank reversed the transaction as unauthorized. Will I be able to get my money back? Nothing was shipped to me and the seller never even responded to the claim. I don't want to lose my hard earn money.

I follow the whole thing except where you say Paypal could not refund you. f they ruled in your favour you should get a refund of some sort. Maybe not all the money, there are different amounts of cover depending on your seller. You should call Paypal to clarify.

This is what the email they sent me said:
"After careful review, we have concluded our investigation of the Buyer
Complaint described below.

We have decided in your favor, however, we were unable to recover any funds
from the seller's account. As stated in the PayPal User Agreement, recovery
of funds associated with a Buyer Complaint cannot be guaranteed."

This is what it says on the resolution page:
"We were able to recover $0.00 USD from the seller and processed a refund to you.
We're working with the seller to recover the rest of your refund. We'll let you know when the seller is able to full refund your payment."

I am guessing they simply took my money and deposited it into their bank account so paypal won't refund my money. Paypal already closed the claim, so I contacted my bank. The buyer protection policy is a joke.

did you pay with credit card? if so, call your credit card company and do a chargeback. if you paid with funds, then i don't think you can do anything. it seems like the person cleared out their paypal. only thing is if more money goes into that account, they will freeze it and hopefully return it to you and anyone else due money from this person.

I paid with my bank account, not paypal funds. Like I said, my bank is doing an investigation. I'm just wondering what are my chances of getting my money back now.

Has anyone ever been in this situation? Whether as a buyer or seller, what happens when the bank gets involved?

i've never had this happen. i'm sorry you are having it now. but i think if you authorized the transfer, there isn't much the bank can do. but have you called the police in the sellers town/state? they took your money but never sent the goods.

This also happened to me. Within minutes of paying for an auction I received an email from another eBayer who clued me in about a scam that the seller was doing and I was their next victim. I immediately called Paypal to reverse the payment. (I am talking less than 1 hour) and Paypal could not reverse it because the seller had already requested the funds be dispursed in the form of a check. It was unbelieveable dealing with Paypal because all I heard was "I am so sorry. We will do our best to get you your money back". I too paid with my bank account, something that I will never do again. Another thing I never knew was the Paypal protection that each seller has. My seller had $200 and my transaction was for $800, so Paypal explained to me that if they determined there was indeed fraud, I will only get $200 from them. What a joke! I was furious at the whole situation. I kept telling them to just stop payment on their check , which seemed like the most logical thing to do and they said they could not.

Eventually, I too received the letter stating that they ruled in my favor, but my seller had no money in their Paypal account and therefore could not reimburse me. asked about the backup credit card that you need to place on file with them, and they stated this was not allowing them to process a charge. The Paypal people were even able to tell me that the seller did not have enough money in the checking account to charge them back with and I became so frustrated.

I started sending threatening letters to the seller telling them I was contacting the FBI, the Internet Fraud Division, and even went so far as to research who the Chief of Police was in their town and in my email stated that I had contacted that person and used their real name so that it looked like it was for real. I have to tell you that I think I hit a nerve with that because they emailed me back stating they would deposit money into their Paypal account. I went one step further and insisted on a Postal money order overnighted, which I got. Paypal suggested this to me because I would get it quicker and I could bring the MO to the post office for them to cash it. They authenticate it in front and you and give you the money.

Sorry for the long story, but if you want your money back I suggest that you take things into your own hands because Paypal could really give a S***. I felt so betrayed during this whole situation.

Good luck - start researching and writing those nasty emails because Paypal is not going to go out of their way for your money.

I tried emailing the seller, and even PMing her where the ad was placed and no response. I know she saw them because it shows that she has logged in recently. She is in Canada so I don't know what I can do about going to the police or taking it to court. It was less than $100, btw.

The same thing has happened to me recently. Paypal was able to recover 5.15. I emailed the seller and she emailed me back telling me that she had a death in the family and that she will send out my item this week (last week). Still nothing. So i emailed her again and told her that she has a week to either refund me the rest of my money or send the item, or I will be filing charges against her.

No response yet but I will be emailing her again letting her know I am filing charges.
BTW, this was in May.
