I had this same situation with a pair of jeans I sold. I also listed the measurements but of course I got an email a few days after they shipped telling me "something is wrong with these jeans....they must be seconds or flawed" even though they were not. I just went ahead and refunded her the $$....I guess in the end I didn't feel like fighting with her and going through all the paypal/ebay crap! Sometimes I feel like it's just easier to take it back and do the refund even though I get so mad and don't want to!!! I know how you feel....it's soooo annoying to deal with people like that. ITA that when you buy designer clothes/shoes on ebay, you are taking a risk that they may not fit perfectly....but that's the price you pay for getting them cheaper.....it usually works out for me but I've had to sell 2 pair of jeans that didn't fit quite right....she could easily do that! Good luck whatever you decide to do!

u can ask her to pay the restocking fee...10-20% b/c she cause you so much more work...tell her you are doing her a favor since you listed the measurement and it's her fault for not measuring herself.

agree with a poster - someone is in denial about her size...

Thanks everyone - here is my last response to her:

"I have contacted ebay as I do not feel I have done anything wrong or described this item erroneously. Measurements and size were listed, and I stated that Cue sizes generally run large, which they do."

I have bought cue items on ebay countless times and for some reason one time the style did not fit me. I NEVER would have gone back to the seller and told them it was faulty. I have never encountered this before so I'll see what ebay says...

"You may be able to justify your behaviour in this matter to yourself and quite possibly to ebay, however I am an ethical person and I know that you have sold me a piece of clothing that has faulty sizing. Please do not contact me again. I am going to consider what to do, but I do not want to waste my attention on you and your unsavoury attempts to gain a few dollars."

The problem is that if she opens a dispute and PayPal forces the refund, they will charge you for the privilege.

Unfortunately, when you accept PP, you also accept returns. Their decision trumps yours. If, I were you, I would just have her return it and refund the purchase price. Besides charging you for refunding, they will also refund the original shipping.

That depends, though. It doesn't work that way everywhere.

OP: That's why I asked for the buyer's location earlier. It's OK if you don't want to post anything about that. What's important is that you know what applies when it comes to your transaction.

bellacherie did not make the dress, she's not the manufacturer/designer, how can it be her fault? If your description and measurements are accurate maybe you can win the case. I would talk to paypal and see what they say. Maybe she should return it to Cue and complain to them?

I did suggest she take it to her local Cue store and see what they thought. If they confirmed that it were faulty as she claimed I would have refunded. The fact is there was nothing wrong with the dress apart from the fact that it is too small for her -

TBH I'm too damn nice and was about to start the refund process when I got that last email. Since I'm not allowed to email her again, that won't be possible.

As you can see by my constant editing (LOL! ), I'm extremely anal (almost OCD!) and check and double-check everything I write and if I'm selling, measure and remeasure things etc. but, even then, I know I still occasionally make mistakes...

Admittedly, although I'm OK at maths, I'm slightly numerically dyslexic (never can remember what the correct term for that is?) and so, I may well be more prone to numerical errors than some (especially if I don't double-check), but even so.

Therefore, once the item had left my hands, so I couldn't remeasure it, yet again(!), I wouldn't be able to be 100% sure (even if I was 99.9% sure) that I hadn't made a mistake.

This fallibility that, really, we all suffer from, don't we (numerically dyslexic, or not!)(?) is another reason why it's better to just accept returns, IMO and if, once it's returned, it turns out the item definitely wasn't misdescribed, to refund minus the shipping fee.
