Hello wonderful ladies of the tPF forum. So I'm at a bit of a lost. A month ago, I bought a used expresso julianne from the bay. Here is the listing that I won: http://cgi.ebay.com/ws/eBayISAPI.dll...=STRK:MEWNX:IT
The description said: "A beautiful Coach handbag like new no scratches on it at all excellent condtion only used a couple of times All Sales Are Final the mesaurements are 16 handles wtih 6 drop 15(L)x13(H)x5(W) it retails for $458 any questions email me happy bidding." Instead, I get a bag without the dust bag - which I don't care too much for. NO LONG STRAP. The leather was worn in many places and there were pink discolorations on the leather. Here are pictures of what I got. ![]() ![]() ![]() ![]() I contacted the seller immediately regarding the condition and the missing strap that was not disclosed and wanted to return it. The seller did not accept returns, but the bag was NOT AS DESCRIBED. Am I wrong about this? Anyways, the seller first told me that they had a death in the family, and was going to refund me when they got back. A week later, I didn't hear anything, so I contacted them again. Then the seller told me how they had lost their job and that they had agreed to do a partial refund. $210 is A LOT for this very used bag. Still no news. Two and a half weeks went by and I contacted them again - and they told me they didn't have any money to give me. It's literally been 30 days since I've paid for the transaction, so I opened up a claim on paypal. They denied the refund and it resulted in me escalating a claim. Within an hour - I got a message from paypal stating: "We have concluded our investigation into this case. Unfortunately, at this time we are unable to decide this claim in your favor." Seriously? How is this protecting the buyer? Did I wait too long? I thought I was being nice and patient. I'm really confused and upset and not sure what to do. Any advice is appreciated. Thank you. |

All's I can say is I'am so sorry. Its so hard when you put your trust in private sales, ebay etc. Because you never know what your going to get! The seller knew what he/ or she was selling. Sorry better luck in the future!

Try posting in the ebay forum..they may be able to help you more!! So sorry that this happened to you.

Wow that is a hard situation to be in. You were right to file a claim and did so within the 45 day limit of filing a paypal claim. It sucks but you got a shady seller who was very aware of the flaws in their item. It's a tough pill to swallow but ebay can and is very risky at times with purchasing things. You can never be completely sure of what is to come once paying for something. I would try to rehab this bag as much as I could as far as the discoloration. Sorry not sure what else you can do.

Call Paypal and fight this over the phone. The item was NOT as described. Also, if you paid with your credit card, file a chargeback with your credit card issuer. This bag is disgusting, and the seller is a ridiculous scammer. PLEASE tell me you gave a negative feedback.
Edit: I see you left a neg, GOOD! Now, see about filing a chargeback with your credit/debit card issuer. If you paid via your checking account, you may be able to get your bank to take action as well. |

OMG, I Am sorry, that bag looks in bad shape! 210$ is a lot for that bag in that condition.
Did you pay with your credit card? if so I'd contact them and initiate a chargeback. |

I did pay with my credit card via paypal, thanks I will take action on that tomorrow morning.
Thanks for the advice. I didn't know you could do such a thing (chargeback). I thought once they closed my claim, that was it and I just had to deal with it. |

I still don't understand why paypal didn't rule in your favor, Did you open a SNAD dispute? were you able to send pictures? paypal gives 45 days to open a dispute, so I think you did it within the time frame.
Do contact your Credit card company and always make sure you pay using your CC it'll protect you more than Paypal. Good luck and keep us posted! |

that is weird that they didn't decide in your favour - what had the seller said to support their argument in the claim process?

Call Paypal and ask them why they did not find in your favor. Remind them it was an eBay purchase and was eligible for full Paypal coverage. There was a time recently when Paypal employees were missing that point and treating some transactions as off-eBay transactions, and maybe that's happening again now that eBay is handling more disputes.
You did file a SNAD complaint, right? What reasons did you give for it being not as described? The shoulder strap and dust bag aren't shown or mentioned in the listing, so that might not have been enough. It is probably better to focus on the flaws. If Paypal won't budge, then go to your CC for a chargeback. But I'd try one more time with Paypal first. These are the things you need to do to be covered by Paypal. Did you do all of these? Eligible transactions are covered PayPal protects you when you don't receive an eBay item you've bought, or if an item you've received is significantly different than it was described. To qualify for PayPal Buyer Protection, you must meet all of these requirements: * Use PayPal to purchase an eligible item on eBay. * Pay for the full amount of the item with one payment. Items purchased with multiple payments-like a deposit followed by a final payment-are not eligible. * Send the payment to the seller through: o The eBay "Pay Now" button, or o The eBay invoice, or o The "Send Money" tab on your PayPal account overview page by selecting "Pay for eBay Items" and entering your eBay User ID and the eBay item number. * Open a Dispute within 45 days of the date you sent the payment-then follow the online dispute resolution process. * Keep your PayPal account in good standing. call paypal and ask them why they didn't rule in your favor when the strap is missing and there is pink stuff all over the bag. then let them know you will be pursuing this with your credit card company and for them to expect a chargeback.

call paypal asap and tell them you want your call escalated to a manager once you get them on the phone explain everything to them, tell them the item you recieved was SNAD.

OP... based on what you have posted here, I cannot fathom WHY PP sided w/ the seller. You can call PP and ask them WHY... maybe they will tell you. And you CAN file an appeal.
Or, this is the exact reason why we have CC's... file a charge back. TBH, as a courtesy to PP, as a PP user who might wish to keep her PP account in good standing, I WOULD call PP and at least inquire as to their decision. Just to say that you at least TRIED to work w/ PP. This is the one thing that irritates me THE MOST w/ PP... when they finds against someone , they SHOULD at least have the courtesy to tell them WHY. |
