I don't recommend becoming an annoyance. You could get arrested for harassment.

^ I don't think going there, unarmed, with a friend, or two, who just happened to tag along and knocking on the door and asking for/demanding a refund would constitute harassment; but, certainly, outright threats/creeping around the back of the house etc. might...

If the scammer called the police, even though it wasn't true harassment (which I think is pretty unlikely, BTW, as by doing so they'd be drawing attention to themselves), I assume the police would then ask those accused of harassment what it was regarding and having been told, they would then, presumably, strongly recommend that the scammer refunded, anyway (assuming they didn't also arrest them, for illegally selling fakes!) and if the scammer refused, I can't imagine the police would take the harassment charge any further, can you?

In fact, I think it might make them take the charge of the scammer selling fakes more seriously, if it was causing some sort of, possible, disturbance of the peace...

What I'd be most worried about, wouldn't be being arrested for harassment, it would be that the scammer might, possibly, be part of some sort of organised crime network and/or might be armed...

Of course, it might be a different matter in the case of someone selling SNAD condition bags because, although totally illegal, it's not on quite the same level as selling counterfeits.

JennaVoguette - dang, I'd do the same thing if that was my $1K.

It's been 5 days, I've called, and still nothing. So I'm going to call my credit card company to do a chargeback. I've never had this kind of trouble in the 8 years I've been on ebay and paypal.

^ Hmmm...

Hope this isn't some sort of new precedent?

If it is, I will definitely be scaling back my eBay purchases!

I'm nervous enough buying from eBay as it is!

Oh, one more question, if you don't mind, CD? How many eBay disputes have you filed and over how long a period?

I only ask, as I'm wondering whether they're trying to cap them, or something? If so, that would be very unfair, as some people are just unlucky/have a run of bad luck.

Best of luck with your chargeback, BTW and please keep us updated.

Chloehandbags - I understand what you're getting at, but I've never done this before, so this is my first time doing so in the 8 years that I've had paypal and ebay.

^ Well then, that just makes this even more worrying, IMO...

I still wonder whether the seller was a member of eBay/Paypal staff?

I'm startin to wonder that myself. So I called paypal again yesterday and they told me the never call people , only email. Then today, I get this email:

Dear xxxxx,

PayPal has concluded the appeal of the following appeal.

Thank you for contacting PayPal about your recent claim. When a buyer and
seller are unable to agree on a resolution, PayPal reserves the right to
determine whether an item is significantly not as described. (For more
information on this, please review the User Agreement.) Once PayPal has
made a decision regarding whether an item is significantly not as
described, that decision is final and cannot be appealed.

We make this decision based on the guidelines outlined in our User
Agreement and after careful consideration of all available materials
provided by buyer and seller.

Sincerely,

I went to my paypal and the case is closed. No explaination or anythng. Just closed. I'm so angry right now. I dontthink I'm going to buy eBay or use paypal ever again. How is this protecting buyers?!?!?!

I don't know. IMO, you should have won this claim, and WHY you lost it is beyond me. Some little "technicality" maybe??
Irregardless, you have done everything humanly possible here.... file your CC charge back.

^ Yes, file away.

Sorry you've been put through all this so unfairly, CD.

Wow, That is crazy! you should have won. Paypal really sucks! they aren't even telling you why they ruled against you? did they not see the pictures of the bag? that is weird!!
File a chargeback with your credit Company, you have given Paypal too many chances to do right and they haven't!

Paypal siding with the seller is unusual, but a tiny bit of good news for sellers. The question is WHY did they??
