Default Advice Needed!!!!

I submitted a best offer for two items from the same eBay seller, they have over 800 feedbacks and 100% positive. I paid as soon as auctioned ended and I recieved the package today. Upon arrival the box was very beat up and open but the item inside was not harmed. The item inside the box was not the items i paid for it was a different bag altogether but by the same designer. I called the seller this morning and she apologized for the mistake and was very nice about the situation. She sold the bag I recieved to another buyer in another country, she did not ship the bag her sister did. The seller said she would do everything she can to make it up to me which I appreciate. I called the seller six hours ago and she was suppose to talk to her sister about the where abouts of my bag and get back to me but I still have not heard anything. I dont know what to do I do not want the bag she sent to me I want the bag and wallet I paid for! Should I send the bag back to the seller right away or wait for a refund or wait to see if my bag and wallet show up? Just to let you know this is not a small dollar amount it is $1300.

This sounds like a situation that can be worked out amicably between you and the seller. However, if she does not respond to you by tomorrow or Monday, I would go ahead and open a SNAD dispute. It can be closed at any time prior to the escalation date, you will still be communicating with your seller, and it will encourage her to move a bit faster than she might otherwise. I would NOT return the bag without having a dispute on record. Once the dispute is open, you can discuss returning the bag that was sent within the dispute, for your own protection. You might even email her to explain that you are planning on opening a dispute simply to protect yourself. The dispute will not harm her seller record as long as she makes good on what she said. If you do not have to escalate to a claim, great. If you decide to do a chargeback, the dispute is already open. This just protects you from many different perspectives, IMO.

So even if the seller is willing to work I should open the dispute? I really feel bad about doing that since she is selling other items and I do not want to ruin her paypal account. Should I wait for the refund before I return the bag?

I'd try to work it out with the seller first. You have 45 days to open a dispute. Maybe you should just tell her that you would like to send the bag back for a refund. If her sister shipped your bag to someone else, it will probably be awhile before that buyer receives the bag and sends it back to her. I'd just ask for a refund...

No, wait to open the dispute. You have 45 days, so just make sure that time doesn't expire and give her a few days to try and figure it out before you go there. Open a dispute only if you have to IMO.

Give the seller a few days to take care of this, you will have plenty of time should you need to file a claim with paypal.

Allow at least a few days to pass for the seller to work things out with her sister and get her story straight. Submitting a claim with Paypal may affect the seller's ability to continue using her account and you don't want to cause her any trouble if she's willing to co-operate and sort the mix-up out with you promptly and amicably.

Yes that is how I feel this seller is willing to work with me so I do not want to mess up her paypal account. She is the nicest seller I have met so far on eBay. But my question is if I opt for a refund should I wait to get my money before I send back the bag I have? Thanks

MOST sellers won't give a refund until they receive the handbag first. Which is completely reasonable. I would never give a refund before receiving the return. That's just not common practice for anybody.

I think the only way that would be acceptable is if the bag was a fake and you were able to prove that it was a fake.

Otherwise, wait until she agrees to give you a full refund upon receipt of receiving the bag that was sent to you, and then ship it back with delivery confirmation, signature required AND insurance. If you do all of these, you should be safe if something happens to the package in transit.

Just be sure that when you ship the bag to the seller, you get proof of delivery. She sounds like a seller who is more than willing to work with you. I stand corrected about opening a dispute this soon. Sorry! You do have 45 days in which to do so, so try to work it out first.

I sent the bag back last Monday it arrived to the sell on Wed so it has been over a week and I am now waiting for a refund.

Wow. Still no refund? That's not good. If you don't receive the refund by Saturday, I would definitely open a dispute/claim through PP. Because if she has been in possession of the return for a week now, there is no excuse for her not to give you the refund immediately. She is clearly procrastinating.
