Don't worry, they're both real and both gorgeous! Yes, it's possible for there to be small differences on the same style bag. From the creed, I see that these two bags were made in different months and in different factories, so it's very possible for there to be slight differences in some of the details. They are also two different colored bags and sometimes details may vary among bags of the same style but different colors.

i always thought the creed was gold on legacy, was there other that werent? theres an x on the creed so could it have been a fake sold at marshalls/tjm

It looks ok. This was probably a pilot bag. Some of the early versions of the Legacy bags had all brown creeds without the gold lettering. I've seen some like this.
