I recently purchased a true hard-to-find-gem of a bal on bagpassion after reading the positive experiences of many on this forum.
After communicating with Phielle (who seemed very pleasant and accomodating) and being assured of its fantastic condition and that it had not been treated (I am prone to allergies with chemical/treatment smells) I paid a way inflated price for the bag and had it sent to me as an early Christmas present to myself and as a pick-me-up following a stressful time with my mom's cancer treatments (she is fine now, thank God).
In receiving the bag however, I was almost knocked out by an overwhelming scent of lmb as if it had been drenched in it. (it know it is a very good product, i just cannot take any chemicals on my skin or by scent)
I explained this to Phielle in a non-aggressive way, asking for an alternative to store credit as I could not afford to keep a bag I was allergic to, or have in store credit for what would be forever because I was wary of the same thing happening again for her "non-treated" bags.
I then also offered her a "re-stocking" fee as a consolation for her troubles, which I felt was quite generous and estimated as 5-10%.
She instructed me to send the bag back and that she would discuss how they would refund the bag with her partner.
But once she received the bag back however (after I had to track it down as she never responded from herself) her only response have been aggressive denials that it had been treated and she decided that the "re-stocking fee" would be 50%!!!
After telling her I could not comprehend her audacity to take such advantage of the "re-stocking fee" I offered her, and that I would report her to Better Business Bureaus, she changed the fee to 30%.
She has since changed her "fee" to 25% and it has truly been like pulling teeth!!!
I am totally wiped out with this as I only wanted to enjoy a peaceful holidays with my family who are now all together through the cancer saga and almost just want to forget this whole thing .
Phielle is still holding onto 50% of my refund (a little under 1k)...how do I ever go about getting this back??
I have only had positive experiences in buying resale Balenciaga through e-bay and Erica but Bagpassion has totally erased my faith in online sellers.
If you paid by credit card file a dispute with your bank to receive your ENTIRE refund. You were quite generous to offer a restocking fee when she flat out LIED about the bag being untreated. I wouldn't even bother to deal with her if you paid by CC. Deal with your bank and let your bank deal with her.
I recall reading a thread about a bad experience with bagpassion earlier this year. A search may bring it up and if so, you can present it to your bank as another example of her horrible customer service.
She's a member here, posted on the above thread, so perhaps she will now correspond with you.
However, I agree, call your CC company and request a chargeback.
A 50% restocking fee is totally ridiculous.
She is a total crook! You need to call your credit card company now and tell them that you returned the item to the merchant and that the merchant now has possession of the item. You need to request they open a chargeback so you can get your $$$ back! They can get the WHOLE amount back and you won't have to pay a restocking fee. Don't message her anymore or let her give you another pathetic excuse. Just call your CC company now!
Sorry to hear about your situation. Seems outlandish to demand a restocking fee that high after you were misinformed by the seller. Good luck with getting this resolved. Please let us know how it turns out...
Thank you so much, I cannot tell you how relieved and thankful I am for your caring and supportive comments. That is a good idea, I will contact my credit card company and paypal as well since that was my payment method.
I have been so frustrated and shocked at their audacity to take so much from my offer that I have not been able to think clearly.
It is almost New Years Eve and I do not wish to be thinking about this or messy fraudulent sellers, but again I am just so very grateful for hearing some caring thoughts and that there is a solution.

Sorry about this situation, especially as it was a "pick - me - up" after your mother's recent illness. I hope you resolve this issue and thanks so much for sharing. I had been looking at her bags again but I'm soooooooooo glad I saw this thread first. She's being completely unreasonable, IMO.

I am so sorry to read about what happened to you! You should NOT have to pay anything, and get your full amount back becasue she was NOT honest about the bag. Right now I am thinking: "Oh, no, not again"!.........I wish you the best possible start to 2009 (and ending to 2008), and well wishes for you family ,
^^ so sorry to hear about this, and I totally agree with lovely64. If eg. a buyer wants a refund cos of buyer's remorse, then a reasonable restocking fee is ok IMO (but 50% is shockingly unreasonable!). But for your case, the seller had actually lied about the bag, you shouldn't have to pay a restocking fee at all! I hope you get all your money back real soon, good luck!
